I was confused because the article says that these police were in Southaven, KY but the court kept citing to the 5th Circuit. Kentucky is in the Sixth Circuit. But it turns out Southaven is in Mississippi.
Yes, both sides offer proposed jury instructions. There are form instructions and the court will of course have a library of instructions used in similar cases. The parties offer instructions and usually most of the boilerplate language was at least similar. But there would always be a few key instructions where the parties would offer something that fit their theory of the case and that’s where the Court would have to decide what the proper instruction should be. That would sometimes get hashed out in a hearing outside of the presence of the jury. My job as a clerk included preparing the jury instructions after that process. Sometimes it was more straightforward than others, but both sides got to see the Court’s proposed instructions before they were given.
