Training is only infringement if 1. The work was pirated. or 2. You include a terms of use contract in the sale and have the customer explicitly agree to it. No an implied agreement isnt enough.

To sue someone you need to be able to ask the court for some relief. Even if it was 100% true, he won - what do you expect the court to do? This isnt about guilt or innocence. What harm was done to him? None. Even if there was a conspiracy (there wasnt) there still wouldnt be anything the court could do. frivolous

Im still not clear on why this law is a problem. 1. You have a policy already, but why does it need to be a secret policy? 2. IIUC you can have a policy and not be bound to follow that policy 100% of the time. You can make exceptions to the policy as needed.

Im not sure you can use the parody defense when its an advertisement. Sure many artists wont say anything, but if they do object I dont think you have the right to use it in advertising.
