  • Shouldn't Intent Be A Part Of Criminal Law?

    Bradley Stewart ( profile ), 03 Oct, 2009 @ 03:26pm

There's The Spirt And Then There's

the intent of the law. A very obvious example of this would be if one were walking down the street with a news paper tucked under ones arm and without knowing it a section slipped out and fell on the street. As luck would have it a copper standing across the street happened to notice what had happened and also noticed that the individual just walked away from the fallen section. Should the Policeman give this person a ticket for littering? Of course not. Yet if the Policeman only considered the intent of the law surely a ticket would be given.

Here Is a Tip That I Received

a few decades ago from a Boarder Patrol Agent. I was sitting in a bar having a few drinks and chatting it up with a great looking girl sitting on the stool next to me in a bar who when the subject came up she told me what she did for a living. I asked her what the surest way to smuggle something across a boarder. She explained to me the surest way to smuggle something across a boarder is to dress up like a middle aged Jewish couple. Boarder Inspectors never bothered them at all. I queried though I am Jewish by birth that when I travel I almost always travel alone. She thought for a moment and then said. Hmm! That will take a more elaborate disguise.

  • New Study Reveals (Duh) Very Few People Will Pay For News Online

    Bradley Stewart ( profile ), 23 Sep, 2009 @ 03:38am

    I Would Pay Up To

ten dollars a month if I received a selection of of news content from at least a hundred or so in or formally in print news services if I was given a menu of content which I could not only choose from but change at will. I'm not sure if I would pay much more than this not because it would not be worth it to do so but money is a little tight for me.

Lets Just Shove A Roll Of Quarters In

When I was a kid I was sitting in a restaurant with my family and the restaurant had a Jukebox. My mother just hated the music being played. She commented I wish I could throw a few quarters in that machine and buy a little silence. I wish that I could do the same thing with all the annoying adds on the internet. I would be happy to pay to get rid of all this annoying junk. Since for the time being we all seem to be stuck with this stuff lets have a board of review rate the adds for entertainment value. Once a month we all get to pick the reviewers that picked the adds that are least offensive to us and those are the adds that we have to watch for that month. This would have benefits for both the sellers and the consumers.

Richard you are exactly correct. You have given a great reason why I really don't know what to do about this situation.

    Hmm?

This is something that I have thought about. I can see both advantages and disadvantages to both being in the bubble of the trial and also being able to research the case while on the jury. I'm not sure which is the fairest policy. I lean toward the more information one has the more likely one is to decide correctly but this is not a given. How about an instant replay? Each juror gets a given number of look ups per day.

  • The FCC, PTC And Bogus Indecency Counts

    Bradley Stewart ( profile ), 12 Sep, 2009 @ 02:24am

    Not Another Naked Person!

Well I used to believe that all these people who filed sexual indecency complaints with the FCC are just a bunch of cranks. Fortunately a good friend of mine straightened me out on the subject. These individuals who file all these complaints are all actually born fully dressed. They go through life not only showering but sleeping in their clothing as well. Yes its true they have never actually seen a naked human body.I now armed with this new though shocking information understand and am more sympathetic to their point of view.

  • Brill Gets More Delusional: Now Thinks 10 to 15% Of Online Newspaper Readers Will Pay

    Less Than Five Years Ago

before I even owned my first computer I subscribed to a dozen magazines. Now If I am interested in reading about something I just look it up on the Internet. I now have no magazine subscriptions. Sure I miss the magazines. Even though now magazine subscriptions are less expensive than ever and I do realize that getting the information for the cost of my Internet connection is putting a lot of interested people on subjects that I enjoy learning about and are great writers out of business I just don't have a lot of money to throw around anymore. As an aside even though I do know where my next meal is coming from things are a little tough financially. I really don't expect things getting better for me soon and for most people in the World I believe things are even more grim.

  • FCC To Study Single Rating System For Movies, Video Games, TV & Music

    Bradley Stewart ( profile ), 01 Sep, 2009 @ 01:38pm

When I Was A Kid Growing Up

my parents had a rating system for me. If I wanted to see it, hear it, play it, or read it, it was OK with them. It worked just fine. Hey if it wasn't for all the nutty Parents, Politicans, and Religous Leaders the FCC could adopt my folks policy. It was nice and simple and clean and by the way it was constitutional.

    Great Idea Huh!

What a really big heart the NFL has. Penalize the fans who can't afford the price of a ticket or tickets in this lousy economy so these over payed dopes if they wern't such good players who most of whom have no other talent would probably be in prison.

  • Could Evidence-Based Copyright Law Ever Be Put In Place?

    Bradley Stewart ( profile ), 22 Aug, 2009 @ 08:55am

    Tough Problem!

I have thought of this problem in terms of medicine but for some reason I never expanded my thinking beyond this. I am glad the author of this article has expanded my thinking. I wish I had the answer. It is a question that needs an answer. Real progress in a timely period depends on it.

  • Do Hourly Employees Even Make Sense Any More?

    Bradley Stewart ( profile ), 13 Aug, 2009 @ 07:34am

I Managed Several Small Company's In

in my life. I found in every company that if I gave the employees a project no matter how large or small they would fiddle around with it forever it seemed to me when it really could be accomplished in a rather short time. I believed the reason was was because they thought that if they finished quickly I would give them another project and another project into infinity. Lets face it that's why they call it work and not fun. Here is how I solved this problem. I would get everyone involved together and say, Hey I'm not a make work kind of guy. Which I am not. Finish this and all you have to do is just take care of the place and the customers. It was amazing. They all moved liked a whirlwind and it was done even more quickly than I could have imagined. The only trick to this is I always kept my word.

  • Wal-Mart Abusing Trademark Law To Try To Shut Down Union Website

Bad Idea To Try And Shut Down

these sites. Its true that under most circumstances its a fruitless effort and it just calls more attention to the Company that is attempting this effort. As to the issue of Walmart I have never been in one because I don't live close enough to shop in one and going through their web site they do have some really good deals but most of the things that they have I'm just not in the market for. Though retired I spent decades in various capacities in the Retail Industry. From everything that I have read about Walmart though no Company is perfect Walmart does a lot more good than harm for both their employees and customers.

    Believe Anything? You Bet!

Its true that the more desperate people are the more likely that they are to become vulnerable.I believe it goes a lot farther than that. Just listen to talk radio or television. So many of these callers seem to believe almost anything that they have heard or read. Critical thinking was, is, and will never be part of their mental vocabulary.
