  "Are they just guessing that no request was made?" No they are relying on the FACT that plaintiffs provided no evidence of such. You have to have at least something to even open up discovery. They had BS.

  No one has said that its illegal to hack your own car. That would be a difficult challenge for them in court. They might try to add a clause to the warrantee agreement that it voids the warrantee.

  Aside from how wrong this is, it also seems it would be ripe for abuse. If I had a grudge against some corp I could redownload the same thing over and over and they would have to pay for it.

  can Colombian courts reach transborder Internet services? [My answer: yes, if they have a physical presence in Colombia]

  Thats bizarre. Why would they ask you such an obvious question? They're judges - dont they know their own law? Sounds like a show being put on for an audience. As such, legally irrelevant.

  Although Carey cant prevent others from using QOC, the other part of this ruling is that no one else can trademark it to prevent Carey from using it. So really she does get something out of it. The ruling is - it cant be trademarked.
