New Florida Bill Seeks To Bury Recordings Of Mass Shootings

Florida legislators are thinking about handing some opacity back to Florida law enforcement agencies in the wake of the Parkland school shooting. The tragedy of the event was compounded by on-site law enforcement's response: that is, there wasn't any. Faced with increased scrutiny over a handful of mass shootings in the state, at least one legislator's response has been to bury the bad news under a new public records exemption. In less than three years, Florida has seen the second-deadliest mass shooting – Pulse nightclub – and the second-deadliest school shooting – Marjory Stoneman Douglas High School. One gunman killed five at the Fort Lauderdale-Hollywood International Airport. Another killed five at a Sebring bank.

Yet Senate Bill 186 would create an exemption to the state’s public records law for all photographs and audio and video recordings that relate to the “killing of a victim of mass violence.” The bill defines mass violence as the killing of at least three people, not including the perpetrator. Violation would be a third-degree felony, punishable by up to five years in prison.

Senator Tom Lee's bill is a gift to the government at large, even if law enforcement agencies and schools will be the most direct recipients of this largesse. If this "privacy protection" had been in place a few years ago, the public would have had no idea how badly the Broward County Sheriff's Department botched its response to the school shooting. Not only would that have kept the BCSD relatively free of criticism, it would have shielded its oversight -- state legislators -- from being asked what they were doing to prevent school shootings and/or ensure better response from those expected to serve and protect the public.

Supporters of bills like these claim it's all about protecting the privacy of crime victims and their families. But as the excellent Sun Sentinel op-ed points out, most requests to block release of recordings originates with governments and businesses rather than the victims and their loved ones. These requests have prevented the public from accessing key details in everything from Dale Earnhardt's Daytona crash to an inmate's death at the hands of jailers.

The law already blocks the release of recordings containing the death of a law enforcement officer. This addition could be read to cover any deadly incident in which more than one person is killed. Any whistleblower releasing recordings to show the public what really happened -- rather than the official narrative -- will now face felony criminal charges for doing the right thing. This isn't going to restore confidence in government agencies and their response to deadly incidents. All it will do is drive a wedge between them and the people they serve.

    Florida... isn;t that the state where the prison guards boiled the mentally ill man to death, forced other prisoners to clean up the carnage, & they declined to press charges?

    There is no real point to this law other than to allow them to hide more details & that works out well. I mean its not like we are still discussing if jet fuel can melt steel beams b/c information was hidden giving rise to conspiracy theories.

    Do it for the victims! Do it for the families!
    Of course if it benefits cops & companies who failed in some way from public scrutiny thats just a happy side effect.
    I mean its not like we've seen families demanding footage of their loved one being murdered released & cops fighting that release until they can do a deep dive into the victim & find previous bad acts to excuse the death.

      That they seem to think that the only thing keeping people from going full terrorist is not seeing a photo/video of the carnage says a lot about what they think of the general public that voted for them.

      I'm curious though, if they think people are that easy to manipulate into murder, would they also be in favor of prohibiting the press from talking about mass shootings? Because if a video and/or audio recording is enough to flip the kill-switch that apparently everyone has, then I'm pretty sure the news doing exhaustive coverage of a mass-shooting would absolutely flip that switch as well.

        I don't think sanity is a major prerequisite for a mass shooter.

        I think there's quite a bit of evidence that (some) mass shooters do it for the attention. I remember one fuck-knuckle in particular, back in '06 or '07, mailed photos of himself posing with guns to NBC right before the shooting. (I'm not going to look it up, because fuck that guy.)

        I think it was extremely foolish and wrongheaded of NBC to air those photos. I think the correct response would have been to discuss receiving them in the mail but choose not to give the killer the additional publicity he wanted.

        I think the media should be a lot more restrained in its coverage of spree shooters. Obviously shooting sprees are news, but I'd just as soon not know the killer's name or see his face, let alone see days, weeks, or even months of in-depth profiles and baseless speculation on his motivations.

        All that said, that's a matter of editorial discretion, and just because I believe the news media shouldn't cover shootings the way they do doesn't mean I believe they should be legally prohibited from doing so.

        On top of which, of course, that's not what this bill is about, at all. That may be the excuse, but it's quite clear that this bill is intended to suppress video that is embarrassing to law enforcement.

          I believe you're talking about Virginia Tech. In which case, the irresponsible part wasn't them sharing the photos. It was the endless baseless commentary trying to guess which games/movies he might have been copying, instead of talking about the actual facts involved.

          The problem is that "mass shooter" is unfortunately too wide a term to make generalisations. Some were clearly just mentally ill. Some did it because they were being bullied, abused. Some did it because they wanted fame. Some did it expressly to further a social or political agenda.

          Now, the problem is that there's only a certain amount of overlap between all of these people. So, the way that's most responsible to cover each event will differ. The guy who just wants fame should probably be denied that, but the guy who's trying to ignite a race war should probably be exposed in order to diffuse any propaganda that would feed into his agenda if people felt something was being covered up.

            It seems to me that both things were pretty irresponsible. We don't have to pick just one; they're not mutually exclusive.

              True, although I can see the newsworthiness of that given the relative novelty of mass shootings at the time, and that few killers outside Zodiac and the Unabomber have a habit of outlining everything for the press.

              I'd certainly question the same reporting now, but the photos were clearly newsworthy - the speculation about whether he was trying to copy Oldboy in one of the photos was clearly not.

              Since 9/11, there has definitely been a push to pretend that terrorism is solely an Islamic thing, especially from the kinds of group Trump appears to favour. No name, no picture, no pondering their motivations, just 'some asshole killed some people, and if you want to help the victims here's some resources you can use to do so'.

    Remembering the human cost of these events

    Kenneth Jarecke took a photograph during the gulf war of an Iraqi soldier who burned to death after his vehicle was hit by an airstrike. He was questioned why he would photograph something like that and he answered "...if I don’t take pictures like these, people like my mom will think war is what they see in movies.”

    I sometimes hate how we hide from the terrible events that happen around us. Photographs from these events remind us of the true human costs of our actions in society and we sometimes need to be reminded of them if we are ever going to change.
