Twitch Streamer Hasan Suspended From Twitch After Bullshit Copyright Strike From Rightwing Organization

from the so-much-for-free-speech dept

It’s beginning to get quite comical watching various rightwing folks and groups bang on constantly about how pro-free-speech they are, often talking about situations that have nothing to do with free speech, only to engage in anti-speech behavior themselves. The new owner of a mountain of debt that is called Twitter has become something of an emblem for this sort of thing, shouting into the void about free speech only to turn on his heel the moment he gets an ounce of criticism.

The point is these people are largely nothing but hypocrites at best or folks completely without understanding for what free speech is, does, and means at worst. And because this sort of thing is contagious, we’ve begun to see this hypocrisy propagate throughout a certain wing of the political spectrum in America.

Meet Hasan, a rather well known streamer on Twitch. Hasan was recently suspended from using his Twitch channel over a copyright strike that, well…

According to this email, it states that the person who issued the copyright strike is from Censored TV, a right-leaning video platform that recently interviewed Kanye West. The specific person the claim came from is Censored TV CTO Ray Aguilar, who claims he’s struck Hasan’s Twitch account as one of Censored TV’s videos featured in his latest stream.

Of course, Hasan has criticized the decision via his personal Twitch account, as he believes the copyright strike was issued to silence criticism of the far right. In a tweet earlier today, Hasan claims that Aguilar is using Twitch’s copyright system to “takedown someone covering and criticizing their silly ideas” and labels the move “absolutely pathetic.”

So, what’s going on here? Well, Hasan hosted a Twitch stream in which he covered a variety of topics, most of them political in nature. As part of the stream, he played the Ye interview from Censored TV — oh, the goddamned irony — and then built upon it with commentary. And if that sounds like something very specific to you, that something would be fair use.

Do the Censored TV folks know about fair use? They certainly should. And, whatever your thoughts on that or your political leanings, stuff like this should make your blood boil.

Not exactly the commitment to free speech that’s been espoused when you’re laughing about getting perfectly protected speech chopped down with a fraudulent copyright claim.

And so you should keep this sort of thing in mind when you encounter anyone, regardless of political leanings, claiming to want something dumb, horrible, or otherwise undesirable on private internet platforms in the name of free speech. Some of us actually keep to that committment.

These clowns do not.

Re:

decry the use of copyright as a tool of censorship.

Maybe your copyright minimalists shouldn’t be using other people’s content as a basis for the content you publish? All the copyright misuse people wouldn’t have any teeth against you, if you just rejected the original material and created something better from scratch… But no, you absolutely must include someone’s hard work as the basis of your videos and content, and add some idiot talking to the audio-channel with some 15 year old kid’s face on the video. That’s not the right way to do it. If you want to make proper impact, you should take gameapi builder, create proper 3d animation and blow up their operation with excellent content that you created yourself completely.

Re: Re:

Okay, Shame of Finland.

Yes or no? Do you believe that one is allowed to criticize, mock or otherwise comment on another’s viewpoints, REGARDLESS of their views on copyright?

Note that if I have to criticize someone, I’ll need to at least look at and refer to their WORDS at least. If I can’t, I can be subject to a slander lawsuit.

yes.

This isn’t necessary. You can skip the words and use some bullshit from your history about how RIAA/MPAA are evil suckers who created horrible mess by suing ordinary americans who went crazy with the paperwork and money demands and how the settlement negotiation was ruined by oppressive stuff coming from MPAA representative’s mouth.

From the EU copyright “reform” explainer:

The Directive allows users to use content freely for purposes of quotation, criticism, review, caricature, parody and pastiche.

If I can’t use people’s WORDS to criticize them, as a form of EVIDENCE, I will be subject to a defamation lawsuit.

If I make up stuff wholesale, especially about other people or products or services, I will be subject to a fucking defamation lawsuit.

What you are saying and what you are implying, Shame of Finland, are so much at odds I have trouble understanding if you are for free expression or not.

Guess I’ll assume the worst, based on YOUR behavior and speech in the past, that you probably don’t approve of free expression, especially when it’s a fucking EU legal right.

There’s different levels of quoting the material:
1) ILLEGAL: reproducing a whole movie as it is
2) ILLEGAL: reproducing the whole movie + adding idiot’s face and different sound track
3) ILLEGAL: mixing and matching of the key pieces of the movie, trailer like
4) ILLEGAL: fan fiction, where your heros and characters are playing different plot twists
5) ILLEGAL: a computer game placed within the movie world
6) ILLEGAL: selling manuscript of the movie plot
7) GRAY AREA: posting screenshots of a movie + text description
8) OK: text description only + artist’s impression of the movie
9) OK: “hasta la vista, baby” style quote database
10) OK: movie database like imdb which contains actor’s names and faces assigned to each movie
11) etc..

Can you see where the illegal line is at?

'It's consequence-free speech, but only for us!'

Another fine example that when US conservatives/republicans boast about their support for ‘free speech’ the sentence should be read as having more asterisks than the MASH title to cover all the exceptions and definitions that strangely enough only apply to them in their model of ‘free speech’.

Self-pity is endemic amongst the far-right. And thin skins. They make HC Andersen’s The Princess and the Pea look like Bear Grylls.

Face it, we are dealing here with a group of One-Man (and One-Woman) Whineries. They are intent on turning the United States into the world’s greatest Whine-Maker. And they invite everybody who looks like them to join them for some of the Whines they most enjoy!

You’d think Gavin McInnes would be more careful as he doesn’t have a great many friends left. He pissed off the far right with his sad attempts to distance himself from the Proud Boys and his fake arrest, he pissed off the center right by getting involved with Ye and being outmanoeuvred by a racist 12 year old and a rapper having a breakdown. He pissed off centrists and debate bros by trying to use them to rehabilitate his image by lying about who he is and setting up debates he couldn’t follow through with and now his company is making spiteful copyright strikes… Who would have thought the one thing to unite all sides is believing Gavin is a d*ck?

Re: Re: Re:2

AC correctly makes reference to the constant call of Republicans to shut up about bans because: private company.

It is the same thing with the stalker piece of crap that got banned. The horror of a sick individual getting banned because he wasn’t a Republican.

And, technically, here.

The reason in this situation is potentially a problem. Asnobody has clarified how much of the interview was used or how the feed was laid out.
The problem with such censorship is we have only the word of the user and fans that the file was actually fair use.
And only the word of the copyright holder it was not.
