One More Time: There Goes Another NTP Patent

from the hit-me-again dept

It looks like the judge isn’t the only one in a hurry in the NTP-RIM patent imbroglio. Following its rejection of a second NTP patent yesterday, the US Patent Office has today rejected a third patent of the company. These are “non-final actions”, and can be appealed by NTP, but the Patent Office has indicated that it expects its next action with all three to be a final rejection, either in whole or in part. NTP can then appeal those decisions, potentially dragging the matter out even further. Again, why does the legal case press on when the patents are so clearly in doubt? The most logical and responsible course of action would be to let the Patent Office do its thing before deciding to shut down Blackberry service or penalize RIM. But, given that it’s a patent dispute, logic probably doesn’t apply.

Silly

Silly, retarded, stupid, etc, would be terms for the idea of letting a judge f*ck RIM (because he is tired of waiting) while the patent office, pathetically impotent and delusional as it is, declares that (NTP) the emperor has no clothes. Of course, behaving in ways that is absolutely against the public good and contrary to the FACTS seems to have nothing to do with this nimrod judge’s rulings. He seems to rule for no reason other than that he is bored with the case. For a judge in a PATENT DISPUTE to declare that he won’t wait on the PATENT OFFICE to make a ruling is sad, and shows just how out of touch this judge is.

Since we can give some defendants the death penalty with obviously insufficient evidence, can we also give an ignorant judge the death penalty for completely ignoring the responsibilities of his office because he is impatient with the patent office and bored with the case? No? Why not?!

Re: Be careful when insulting US judge

Hey, who the fuck are you to insult US judge ?
Judges and juries are all we, little guys, have to protect us from the big evil guys.
In this case, the judge was following the Law to
the letter, isn’t it what we all want ?
His initial ruling back in 2002 (injunction for Crackberries) was upheld on appeal, by the way.

His initial ruling back in 2002 (injunction for Crackberries) was upheld on appeal, by the way.

And since then, the USPTO has rejected three patents and is leaning towards a final rejection on these three patents. Justice works both ways. If three of the five or six patents that RIM supposedly violated become invalid, what validity is their in the original ruling and appeal?

You are convicted of murder and said conviction is upheld on appeal and put in prison. New credible evidence surfaces after you are in prison that proves you are not guilty. Based on your post, it sounds like that you are stuck in prison, regardless of the new evidence, because the appeal court upheld the original decision. Sorry. Too bad. Go to jail.
