Nano Lawsuit Makes Apple Hyper-Sensitive?

We reported last week how a class-action lawsuit has been filed against Apple regarding the apparently easily scratched screens of the iPod nano. Now the company has told its service providers to replace any 5G iPods that exhibit any kind of hardware failure — even as the result of abuse — no questions asked. Just to emphasize, these are the new video iPods, not the nanos covered in the lawsuit. Could it be that Apple’s trying to pre-empt any further lawsuits from disgruntled early adopters? Or did they need some help with beta testing? Perhaps all these issues are a roundabout way of keeping the iPod accessory market going strong.

people need to get some common sense and buy a screen protector or case! All of my friends have iPods and some have cases, some don’t. Guess what? The ones who have cases haven’t had a single problem with the screen. The people without them are the ones with problems.
On my two-year old PDA, the screen doesn’t have a scratch on it because of those screen protectors. I know its been vouched here before, but just spending the extra 10 bucks to get a case is worth it.

There haven’t been ANY cases for the Nano, the best on can do is get a screen protector that you spoke of, but that still wont protect the screen against impacts. The IPOD nanos are VERY delicate and mine (having never dropped it or hit it against anything at all and having few to no scratches) stopped working completely on my 10th day of ownership…needless to say it went back.
Bottom line, get an IRiver they kick any IPODs butt anyday!

No, dude, the iRiver is a lame piece of crap. Nice try at astroturfing. And yes, there are cases out there. In fact, there are about a dozen companies making iPod nano cases. A whole collection of them right there on store.apple.com.

What evidence do you have to back that stance? I own a iRiver and love it, it does what I want. I imagine if I owned and iPod I’d love it too because my expectations would be different.

Anyhow, what boggles me is that there would be any reason for a suit at all. The “scratches on the screen” issue is not something that just happened with out abnormal use of the product- as long as Apple doesn’t claim they will replace any scratched screens in their limited or extended warranty then not stand by their word then I don’t see grounds to sue…

The class suit is about the fact that it scratches so bad through regular use that you can’t use the product (can’t see the screen).
I see that as a pretty damned good reason to sue for replacement. And, since I’ve found out about it, I still haven’t removed the plastic cover that came with the iPod. Although it’s starting to peel off. I just hope that the case I preordered comes soon.

“what evidence?” How can you provide evidence of an opinion? Anyway, I know a couple of linux users that cheaped out and bought them.
Both of them had the iFP-799 players (linux dorks that just LOVED that it played OGG) and ended up getting rid of them and getting iPods instead.

Sorry man, but they sell precisely 2 kinds of protectors for nano. 1 is the armband, and 2 are the fugly rubberized sleeves.
I got a nano and I’ve been searching for some kind of a case for it that I would want to have on my iPod. The first third party cases I’ve found are JUST starting to ship (end of October). Considering that it was introduced on Sept. 7th that is way too long to run without a cover/protector.
I actually went to my nearest Apple store as soon as I got the nano (for my birthday) and they basically shrugged and said “Sorry, why don’t you knit yourself a sock for it”. Apple’s obsession with secrecy is such that not even case manufacturers knew of the nano and are still running to catch up.

The BBC ran a “pocket test” of the iPod nano.
The premise being, that it is reasonable to expect to be able to keep it in your jeans pocket without getting any scratches, as long as you don’t have other stuff in there.
So for one day, they carried an iPod nano around in their pocket (nothing else in the pocket). Afterwards they examined it and found that it was covered in small scratches.
This is why their is a lawsuit. The pocket sized music player is not up for the purpose of carrying in your pocket.

Bottom line people should be able to do whatever they want with their ipod, seeing how much they are, and not be worried (to a certain extent – that doesnt warrent wrecklessness) about there screen failing them. Theres no reason they couldnt have equiped them with a screen that is more sound than what they currently have. The only reason would be to save some $ and in the long run thats all that matters now a days.

Having a new screen put into any electronic device (except a laptop) will cost more than the device itself. And who exactly makes these third-party custom LCDs for the iPod?

Why would someone reasonably expect that putting a small electronic device w/ an LCD in the pocket of your jeans won’t damage it in some fashion? A shirt pocket maybe, but not your pants. Even if it didn’t get scratched, I’d expect some damage to the LCD.
It’s not like jeans are a soft material; people don’t clean their glasses with a pants leg.

I have to agree with you on that point. Someone at APple should have realized that “hey, maybe people will buy a protection of some sort. Why not make one?”

No, you’re wrong. Go look again and open your eyes this time. Belkin makes the same folding leather case for the nano as they did for the iPod Mini.
but really, what other “kinds of cases” were you looking for? Titanium?

I own an Ipod and an Iriver and the Iriver dominates the Ipod in so many different ways that I cannot even begin to start.
