NextWave Has Court's Sympathy

The Supreme Court heard NextWave’s license dispute yesterday. The initial take is that the Court is siding with NextWave’s claim that the FCC’s repossesion of licenses went against brankrupty laws. At the heart of the issue for the Justices is if the FCC is overstepping it’s role as a regulator and acting more like a creditor. In the end though, isn’t it their job to make sure that the governement is paid for licenses that the regulator has carved out? Whatever decision the Court reaches it will set a precedent that will set new boundries for the FCC.
