Replay: Napster Or VCR?

An article that takes a look at the lawsuit against ReplayTV to see if it’s more like the Napster case (illegal trading) or the old Sony Betamax/VCR case (substantial non-infringing uses, so it’s okay). Since I still think that Napster should be completely legal, I don’t think it matters, but I don’t think it’s difficult to support the VCR arguments. There are obviously “non-infringing” uses of the Replay device. Plus, I hadn’t realized that you can only share your Replay recordings with 15 people. It sounds as though it’s much more similar to a VCR than a “trading” mechanism.
