    No, it's not content. It's a link, a headline, and maybe a quote. Fair use dictates no need to compensate. And all of it is controlled by the media agency, as they define what is in the card. They can also prevent facebook from posting it, if they want. You also fail understand that the audience is where the value is. Not then content.

    We know it's not worth paying for because a law had to be created to force the transfer of funds. In the few cases that it folks thought it had value, they had negotiated rates. But those didn't appear to work out, so Facebook is shutting down.

    To me, lowering this bar for migration from service to service would be the first step to actually addressing the problem of gatekeeping. And there's no reason to limit it to the major players. First and foremost would be to require all service/software providers to have an easy and straightforward way to extract all user generated data. And I mean all of it. No undocumented file formats. No obscure and proprietary databases. My data shall be mine at all times. Second require that the account termination process is. I more onerous than the account creation process. Don't call to creat an account? Can't require.peolle call to get rid of it. The third thing I think would help, but I'm not sure how to do it practically, is to require that seperate products/services from the same company only interact through the published APIs/ABIs, etc. no backdoor, super secret, proprietary interfaces that companies keep for them selves, while offering an inferior interface to third party developers. Amd then finally, start requiring software to meet minimum standards for things like data safety, usability, etc. That way NRTLs could begin to test the suitability of services/applications for their claimed applications. No more shrinkwrap/clickwrap that says 'we promise nothing of our software, and you can't sue us if it fails'. A software/services lemon law wouldn't be bad....maybe treble damages for loss of security and financial information, and a fine with an escalating costs per events with indirectly identity cost such as loss of PEII. These would dramatically upset the industry, and would have a devastating impact on the incumbents ability to build moats and abuse users, while actually benefitting users.

    I'll swing at it. For starters, the EU definition of 'technology gatekeeper' has nothing to do with technology or gatekeeping. "The first is that a core service must have over €7.5 billion in annual turnover and be offered in at least three EU Member States. From there, the company needs to have 45 million users or more. Finally, the companies need to have met the second criterion over the most recent three years." It's money. If you make a lot of money, you're a gatekeeper. Let's take a look at YouTube which is just incredibly popular. There are no exclusivity requirements, so contributors often post on other channels, advertise for direct competitors, bitch about the moderation and pay, etc. Its protectionism first and foremost. Look at the companies that are listed as technology gatekeepers.

Do you see how fucking weird it is to insert it into a conversation? And how emotionally stunted it is to justify your behavior based on the behaviors of unrelated parties? But, to get to the point as to why everyone treats like crap here: From the trolls, to the regulars, to the writers, to even the rando anonymous drive by posters: nobody takes you seriously. Not even a little bit. Not about inconsequential details. And especially not when it comes to your opinion about the law, contracts, or anything else that requires even a modicum of technical understanding. You have shown an unwillingness to read, comprehend, and learn on virtually every subject under discussion on this blog. And this isn't judgment on your intelligence. To me, it's worse. Everyone has determined that you're constitutionally incapable of viewing the world through nonpartisan lenses. It appears to be physically impossible for you to admit defeat, correct a failed argument, or change your opinion. Which is logically flawed, emotionally stunted, and demonstratively ineffective. It's not something a rational person would do, especially one who truly wishes to 'correct' people as you regularly claim. As a result of this one dimensional behavior, at first I thought you were a troll. But at some point in time, even a bad troll tires and moves on. Or changes their shtick. Most good ones will even go so far as to act rational for much of their interactions to build credibility before arguing a absurd position based on patently incompetent understanding of a phrase. As you so often do. But no. You're here, for reals. With a deep investment in the subjects, but all viewed through the distorted lens of irrational fundamentalism that leads to a comical level of incompetence.As a result, you're always, always wrong. If there were ever to be on occasion where you were correct....nobody would believe you, or even care for that matter, because you wouldn't have arrived at the correct conclusion through logic but instead through religion. It's an irrational approach that fails you time and time again. But it also prevents you from learning from those failures and your arguments can't be built on the strength of logic or reason. They must be built on volume and capacity. You, much like Musk, rely on others simply becoming exhausted with your behavior and moving target. Lacking the sophistication to develop well founded position, you employ faith based arguments heavily cribbed from a personality cult that a substantial number of prominent participants find distasteful and repulsive at worst. At least they get something tangible out of their support. But you're getting nothing out of your argumentative bullshit approach but further scorn from a group of people who you clearly care deeply about their opinion of you. This is also why you can't ever drop a single thing. You've always, always got to have the last word. Even if it's a restatement of an incoherent argument that is competently unsubstantiated. You'll be back to post. Again and again. You'll do it here. A week from now, you'll still be responding with your usual nonsense, just to get the last word in. Despite the raw volume of posts you make, at no point have you ever improved the conversation, educate a single person, or demonstrated even a modicum of understanding of the core subjects. This is statistically impossible. At some point, you should have accidentally posted something correct and agreeable. But that hasn't happened. Instead, you post incoherent analysis that are sophomoric at best, and usually idiotic, with a condescending tone that's a clear mask for your complete and utter ineptitude. All of this, combined with your sanctimonious and condescending attitude towards everyone who is better informed, better educated, and especially those who have demonstrated their credibility again and again, make you an incredibly annoying presence.     These are, presumably, sophisticated legal entities that have executed hundreds if not thousands of business contracts. We know that Elon has an extensive exposure to contracts simply based on the number of lawsuits he's in for violating said contracts. In fact, didn't he insinuate or outright state he "really understood the law" because he's been around lawyers? Either way, they all certainly have very pricey lawyers on retainer, and have used them extensively in the past, for these kinds of endevours. t's going to be a tough row to hoe for Elon to argue that he just oopsied his way out of proper execution of a contract and that the court should take him at his word.

    Kootenai County is the the very dumb point of an extremely rightwing spear. If you want to know where the Republican party is going, the Kootenai County Republican Central Committee shows you just how ignorant and spiteful they can. The MAGA/GQP/Tea Party crowd managed to take.solid control of the area and are using it to burn down everything they can for....reasons. In just 3 years, they have effectively destroyed the North Idaho College through epic miss management,and are on course to lose accreditation. I could spend hours outlining the stupidity, corruption, and spiteful behavior. Summer Bushnell, who runs the Bushnell report and is heavily involved in promoting the KCRCCs platform, is the subject of a defamation lawsuit because she claimed a drag performer was exposing their genitals during their performance on a public stage in the middle of a park. She even went so far as to post a video that she censored out the crotch of the performer and encouraged people to call in and report public indecency to the police. Who managed to find the original video and saw there was no such thing. Kootenai County Assessor Béla Kovacs(R) was most recently recording conversation and deleting some of them. But because of public records law, that is very much is illegal. And why was he doing this? Because he's fucking up the job so much he's impacted county budgets, made errors in assessments, and had his salary withheld. The library has also been dramatically undermined because they KCRCC was able to whip enough morons into a frenzy and elect a group of bigots to the board...who are trying to dramatically change the way resources ande selected and placed in shelf. And they are doing it in closed sessions which are an outright violation of the law. Thy also had a uhaul of Nazis.

    My evidence is Netflix. When they cracked down on password sharing and added an add based tier the saw a growth in advertisers. They introduced enough friction, and the cost was low enough, that paying was the preferable choice. I also maintain that it's an increasingly irrelevant distinction that a show is time delayed on YouTube but then hosted on either MAX or Nebula. Functionally, both provide identical services to me. On demand, streaming content, with a catalog. The incumbents in the space desperately want this not to be true, but it is and that's why they are getting absolutely hammered.

    When it's on YouTube, it's an ad for the main show on HBO. The HBO show is just as relevant as it ever has been while the ads are now less relevant. Like lots and lots and lots of other content on YouTube. This will probably be incentivizing people to go and purchase their main product if they see value in the topical nature. If the practice is as bad as people are making out for, HBO should know in short order. But I doubt it. I also contend that its a very valid business practice that doesn't indicate enshitification based on the fact that I gave a dozen or so examples contrary to the claim. Do I have stock with WBD? That's a bullshit, low quality, accusation for someone that has an opinion that differs from you. Do better if you want a response.
