Carriers Want Protection From State Level Termination Class Action Suits

This issue keeps coming up in different ways. CTIA is now asking the FCC to stop pending lawsuits in state courts concerning early termination fees. While this may look like the carriers trying to stay out of harms way by preventing any kind of class action lawsuit, it is (as usual) a bit more complicated. The real issue is whether or not rules concerning early termination fees can be set on a state by state basis. Just like various other rulings, the carriers would be hard pressed if they had to follow 50 different sets of rules for 50 different states. While, of course, they would like to avoid all such lawsuits — if there needs to be a rule about early termination fees, it should be done at the federal, rather than state level.
