Keystroke Logging Is Not Wiretapping…

Earlier this year we discovered that having an ISP read your email is not a violation of wiretapping laws. Based on that decision, another court has decided that using a keystroke logger to record typing on someone else’s computer also is not a violation of federal wiretapping laws. Basically, it seems to come down to the semantics of it all, based on how the original law was written. With these types of cases, which can be summarized in a way that looks bad in the press, it’s likely that some politician will try to rewrite the wiretap law to make it more inclusive of modern technologies.
