Overture Tries To Force T-Online To Keep Them

Last month we wrote about how Overture had lost their first customer to the Yahoo buyout – as T-Online believed that Yahoo was too much of a competitor to remain an Overture customer. Overture, however, has a different opinion on the matter and is trying to force T-Online to live up to their contractual obligations and keep using Overture until the contract runs out. Overture says the court has granted them an injunction forcing T-Online to keep using them. First of all, I would guess that T-Online, if forced to keep using Overture, will do their best to hide any Overture based results. However, I’m especially surprised that the Overture-T-Online contract didn’t include an out in case of acquisition. It’s pretty standard for deals of that nature to let either side opt-out when the other is acquired.
