Fighting Microsoft In Small Claims Court

Some guy who has been selling a “gag gift” for years called the “pocket pc” was upset to learn that Microsoft registered the domain pocketpc.com over a year ago. So now, he’s taking them to small claims court to win the domain (and $5,000 in sales he feels he’s lost out on). I think the guy is going to have serious problems proving a trademark violation, but if that’s what he wants to do. It’ll at least get him a lot of publicity in the meantime.

He should have gotten off his butt
He should have gotten off his butt and registerted the domain name before MicroSoft came out with a competing product. Yes they are competitors, the plaintiff sells a gag gift and MicroSoft sells…
However, if a big company or personality can appeal and take a domain away from legitimate small company then the reverse should be true. If this fellow had a real business selling gags then he may have a case.

He has more of a business selling PowerPCs than Microsoft does. AFAIK, they don’t sell PCs at all, and definitely not PowerPCs.

Pocket PC, not Power PC. I agree with the first reply – in this case it looks like first come, first served and he is just SOL.
