Suing Nike for Letting Themselves Get Hacked

So Nike’s web page got messed up recently and re-directed through a British server. Now the guy who runs that server is suing Nike for all the traffic. I understand how this might be a bit of a pain, but I’m not sure suing Nike is the answer. He says they were negligent in allowing themselves to be hijacked. It sounds to me more like he’s suing where the money is, and not who’s really at fault.
