Equifax Says It's Un-American For People To Know What Equifax Knows About Them

It’s tough to figure out where to start on the various comments from Equifax boss Thomas Chapman, who claims that the new law requiring the big credit companies to let people see what data has been collected on them for free at least once a year “unconstitutional and un-American.” His argument is that it “cuts into the profits” of his company. First of all, cutting into someone’s profits isn’t unconstitutional or un-American by itself. Second, they’re not asking him to “give away” some random product, but to let anyone check the info that his company has collected on that person to make sure it’s accurate. Considering just how much depends on these companies reporting data accurately, that seems like the least they should be required to do. In fact, they should want to encourage that as it means they would have more accurate data. Besides, part of the problem is really that many people don’t realize just how much data these companies have on them, and how much of it is just wrong. Besides, given the various sneaky upsells, it certainly looks like the big credit companies are actually increasing their profits by convincing people that they actually do have to pay for these “free” reports. The article also gets amusing towards the end where Chapman puts his foot in his mouth big-time by basically saying they’ve had a bunch of data breaches which haven’t been announced, and then trying to pretend he never admitted that, first by saying: “I don’t think you’ve seen our name in the news,” then by refusing to answer more pointed questions on the issue with: “I’m not going to go there. I’m not going to answer that question. We have been notifying and engaging in communication with customers, consumers, for a long time. We’re known for that. We’re known for our stand on privacy.” Yup. Your stand on privacy is apparently that you don’t believe in anyone’s ability to check on their own private data to make sure it’s accurate — unless they first pay you.

Firstly, I have worked since I was 11 years old and I understand Free Market Econommy. What FME does not take in to account is that some corporations are REALLY bad citizens. Our government has become a government of the corporations not of the people because the corporations can buy politicians where the ordinary citizen cannot. Hmmm…I think your forgetting the big ones like Enron, Worldcom, and many other companies who have done the same practices but not on that large of a scale. Yes corporations make the money in this country but even more so they are tied into political iron triangles. Company A makes product for government/or politicans and said laws and taxes are catered in favor. Oh and simple economics, what an oxymoron. I should be able to see my credit report and validate everything in it. When will America wake up and realize that we shouldn’t have to put up with twisted corporate greed. I mean honestly if you earned that house, land, cars, and the junk in it great but don’t get greedy and take from those of us who are hardworking Americans.

Kevin, my friend – enough people have commented on your “simple ecomomics” philosophy, I don’t have much to say about it aside from that businesses making money & paying their employees (which is part of the cost of doing certain businesses) do no go hand in hand with this issue. Equifax are scum. I’ve been trying to get them to fix errors in my credit report for over a year. They claim that I am in collection for unpaid bills (i have letters from the companies involved stating I paid them), and they appear to have confused my father and me, so that our data is mixed together.

They have no accountability. They are required to provide a 1-800 number you can call to talk to someone, but it’s just a touch-tone maze — you can’t reach a real person. They are required to mail you your credit report for free if you request it by mail, however it took three tries for me to get them to actually do this.

Result: I am unable to get credit anywhere, through no fault of my own, and there is nothing I can do about this other than send them mail which they don’t reply to.

UGH. Don’t you understand that a lot of us don’t WANT credit? It’s a sick game that we’re FORCED into.

Try renting an apartment. If you have bad credit, you’ll get denied. I make $120,000 a year but have no credit cards, no car payment, and don’t own a home. I buy everything in cash. Thanks to medical bills (unemployed, had no medical insurance, got hit by some Mexican with no insurance or license that ran and left me bleeding in the street) and a piece of crap company that fast-tracked a lawsuit against me a couple years ago when I was unemployed (and they knew it) I have poor credit.

So my income is meaningless and so is the fact that I haven’t had anything added to the report in years. All that seems to matter is that stupid credit report.

So, fact is, not everyone wants credit but sadly, we’re almost forced into it. Nice system, eh?

I tried several times and even put up the $1.00 to get a report that never surfaced. I called and talked to a real person after munipulating their own voice maze and forced them to reverse the charges. The answer they gave to me for not being able to come up with a credit report was, “I can’t help you”. They were unable to come up with a report at all. I know I exist so therefore I should have some sort of credit report. I pay for everything with cash. I don’t have a car payment but I have two cars. I don’t own a home and never will. The IRS let me make payments to them for my taxes. I paid them faithfully. Shouldn’t that show up on my credit report? I now pay them everytime I get paid they get their money before I get my hard earned money. I make those payments on time. When I borrow $20.00 I pay that back when I say I will. I pay water, cable, PG&E, telephone and garbage every month on time. Why don’t they report my great credit history? Why do you have to be in debt to get a score. I wouldn’t lend anyone money that didn’t have the money, especially when I know, based on their income and other debts, the ability to ever pay it back to me, unless I knew that if they ever paid me back i would get double the amount i lent to them. Thats called extortion in the law books but we call it credit. Go figure. Who is the wiser. I scored when I found out people accept cash for stuff I need.

Well of course they wont help! If they helped everytime someone called then they could’nt charge for thier services. Utilities, while you are required to pay on time, will not report your payments but WILL report you if your turned into a collection agency for NOT paying. You can buy a mansion with cash but that wont help your credit score. Your score is based on you (the consumer) “borrowing” money you dont have for things you dont need.

You are right. I believe the financial instutions are conspiring with the credit bureaus to give Americans the worst possible chance to have a decent life/salary/credit. Most credit reports, in my opinion, are contrived to make us pay more.

In the late 1990’s, a federal credit union (yeah, that’s right a Government agency) sold alleged deliquent accounts to a collection agency (Action Management, Inc.) for hundreds of thousands of dollars. Once it was discovered the accounts were not deliquent (in fact, the amounts that were alleged to be owed never EXISTED) the FEDERAL credit union altered the accounts to make it appear deliquent. The NCUA supported this. Hundreds of people from this Phila credit union were scammed. And what did Equifax do? They altered people’s credit reports to appear deliquent……..even though the FEDERAL credit union lied about Equifax when the “accounts” were questioned!

People buy goods and services from companies. If you finance one of these goods such as a vehicle. And you have never missed or been late on any of the 36+ payments. Is it fair for you to have the automotive company give you any type of remarks that are not positive? Well you normally would not know. You would just have bad credit and get rejected everywhere. Even for a cell phone.

Now take into account all of the recent activties where people are stealing IDentity (ID Theft). Of course once stolen. They use your name and credit rating to purchase something and never pay for it. Now you have a bad mark. Guess what? You’ll never know and be able to fight it until you put up $100 for your credit report. AND That’s just the beginning of a long process. Lawyer Fees, etc…

If the credit report is supposed to be an accurate national database that every company uses to decide whether or not you are worthy. Should it not be open at least to the individual whose information it contains?

Nether does any founding document expressly states that all business models must be protected. What does it matter?
The constitution /does/ suggest that I have a right to privacy. Does that mean that I can forbid X from collecting information about me?
Forcing X to show me what information they /have/ collected about me seems like a decent compromise.

While I agree that it is wrong for the government to force a profit-making company to give away its product for free, the government has also repeatedly immunized these corporations from the consequences of bad or innacurate credit reports, as well as identity theft, i.e.; if their crappy information harms you there isn’t a damn thing you can do about it. If the Federal government hadn’t created rents for these idiots by legislation, you could bet your house that they would not only give you free credit reports any time you asked, they would actively solicit consumers for their information to help them do their job better. That they do not is a sad testament to the asymmetry of “rights” in this country.

Awesome thread! To differentiate, however: Criminals like Ken Lay need to be treated as such and sent to a real prison. Honest businessmen who make an honest profit need to be emulated and held up as role models. “Greedy Corporations” is a buzzword used to cut off debate.
I, too, followed the links for a “FREE!” credit report, so yes, I know how the bureaus try to get $30.00 for something that Congress has determined we should get at no additional cost. This is annoying behavior, but not criminal. As educated members of society, we can navigate around the creeps, support the ethical, and pressure our elected officials to prosecute the criminals.
Liberal or libertarian or progressive or conservative, we need to work together,
as the politicians WANT us divided, so they don’t actually have to do anything!

The REAL reason credit companies are against this has absolutely nothing to do with the cost of sending you your credit information. What they are interested in, is making it difficult/expensive for you to get your info. Why? Because it costs them money to research and correct your info. once you notify them it is wrong (which they are required to do by law, once you inform them). As long as you don’t know that it is wrong, you can’t exercise your right to force them to fix it. Making this info free and easy to get will dramatically increase their costs (as they know that a lot of people’s info is incorrect).

You “can” (and I say this loosely) and are suppose to by right be able to get a free credit report when turned down for credit reasons. If this works or not I dont know. I use my visa for creditkeeper and get charged a 5$ monthly fee, yes I’d rather not pay the $5, but I get all three credit reports plus ways to change my score. Most (maybe even all) credit card companies have deals like this, the highest I’ve ever paid was $10 a month. If you do it on your own through the credit sites than it can be anywhere (I’ve seen) between 25-100 dollars.

I was denied credit recently, and got my report free from the company (experian) on line. I found only one item which required correction and wrote them a letter to correct it. I did not get my credit “score” with this, so I don’t know how good they think my credit really is! So it was free, but I still don’t know. Guess I’ll write all three to get my reports, but without the score one is still in the dark. Does anyone know how the score is computed?

I noticed someone brought this up before but was suprised this has not become more of a topic for discussion: The “Product” the credit bureaus are selling is YOUR information. It’s information about when YOU bought a car, about when YOU were late on a payment, about when YOU were denied for a loan because there were mistakes on your report…. get the idea? Without us there would BE NO PRODUCT, yet we are forced to pay to see it more than once (and with limited info, no score is included). Try fixing your credit sometime.. you will have to pull reports all the time for at least a year, one report does NO good unless you start with good credit and are fixing 1-2 mistakes. If I were to follow you around, learn everything you do, collect your personal info and then write a book about it and sell it for BILLIONS of dollars, would you want part of that?

Scores are computed through a “bunch” of different things ranging from how many “inquiries” into your report there are (yes it affects your score-lowers it), loans and credit cards and collections (if any). scores are from 350 (lowest)-850 (highest). The best thing to raise your score that I have noticed is to get credit cards, use a little, then pay it off. do not do this every month tho. It shows that while you have credit cards you dont need them.(catch-22). Late payments are not reported until 30 or more days late, but does some damage. There are also differences in the “three” report companies that can be up to 80 or 100 points! So one company might think your good another might have you untouchable. (mine is currently 40 points off).

Equifax abused my life..

I wrote the disputed letter to Equifax twice in 2005 to delete incorrect outstanding almost 10,000 USD on my student loan account with USA Fund. The loan was closed and transfered from USA fund to Sallie Mae.

Equifax put “reinvestigation on process ” on this account for a few months and never respond anything nor remove this account.

One year later in 2006 I have checked my credit report from Equifax again and found out Equifax removed the word “investigation on process” out and remain everything the same especially the outstanding balance almost 10,000 still showing as past due.

I finally contacted Direct of Investigation Department at USA Fund and got a letter from USA Fund to confirm my account was closed with zero balance and was transfered to the new company.

I sent this letter to Equifax again and Equifax still remain this account showing i owe moeny almost 10,000. They didn’t remove or update anything don’t even ive me an explaination why they remain the same

Now it is June 2007. Equifax credit report still have the same information never changed showing I have past due almost 10,000 USD with USA Fund and I don’t understand why Equifax never respond any investigation result to me.

This incorrect account and incorrect outstanding balance showing last activity was in 2003 I disputed in 2005 and nnow 2007 nothing has been corrected.

I get sick of Equifax Company why people rely on this stupid credit report agency. I had a hard time to get the home loan, car loan , apartment and many other issue because of this stupid credit agency .

However, I finally just got the home loan approval by using the letter from USA Fund to proof that I didn’t own any money with them because i had been refused from every lenders from this incorrect account.

Anyway, another big two cridit report agencies are reporting my information correctly. I want to say Equifax is SUCK!!!

My wife has been the victim of identity theft. She has been fighting it for nearly 12 years now. Experion has never had her credit messed up. Trans Union at least tries to straighten things out and at several points during this period has even had her credit correct. However, Equifax is the WORST. They are impossible to deal with. If, you can talk to a person they say that they cannot do anything over the phone. They direct you to a form to print out and the address to send it to. When you fill out the form exactly as specified they only make minor changes that do not fix the problems just change the wording as several posters above have stated.

1. I complained to Equifax about an infamous zombie debt collector “re-aging” an old debt. The operator on the phone told me that companies in their network don’t require proof! When I continued to complain, I received a letter telling me all further inquiries in the matter would be ignored!

2. I wrote a letter to Equifax asking them to insert a consumer statement. 3. Those zombies reared their ugly head again, so I decided to get online copies of my annual credit report. Which is when I noticed the “translation”/mangling of my statement.

4. Looking at my credit report I noticed SIX accounts are duplicated FOUR times each!

5. I tried logging a dispute online – their web site kept insisiting my verification info was bogus.

6. I called. The woman says she’s not seeing it. I told her I am. She told me I can go online and disputs it then. I told her I called because I can’t! She said they will mail me a copy then. I said fine, but I can already tell you the account info will most likely be duplicated. So what am I supposed to do then? Call again and around we go?

7. I have accounts with no activity since the 90’s still listed – shouldn’t they fall off automatically?

I just don’t see how the government can let these completely incompetent morons have such control over our data.

I tried this number today and spoke with three different people: 1 866 640 2273…But get ready to be frustrated I know I was. Talk about idiots! These people really suck and on top of them not being able to verify my identity, they’re requesting that I fax them additional documents to verify that I am who I claim to be. What the hell! Not only do they make it impossible to get your free report, when you try to purchase one it’s just as difficult. They ask questions that pertain exactly 100% not to any situation in my life. As if there is some other BS in my file that I’ve not had anything to do with and when it asks if I have a mortgage or what street I have lived on and I have had and done NEITHER I still get blown off and told to mail them a frigging letter.

This is 2010 and we are still at the mercy of these companies. It’s bullshit. All I want to know is what’s in my file. I paid for a report and I don’t have the report. I’ve had the same problem for at least 16 years. Even when I have paid them to send my “free” credit report, they still wouldn’t send it. None of their on-line “identity verifying” questions ever pertain to me, even though it claims they have “found my file” and need to make sure I’m accessing my own file. I figured long ago that they have sold my spotless identity to someone else, and have been getting paid by companies to use them as an excuse to price gauge me. This game of keep-away further aids Equifax in preventing me from ever reclaiming my own identity.

When everyone refuses to rent to you, hire you, make you a loan, charge you the prices they advertise, etc., and you can’t even get Equifax to respond to the proof (of your good name) that you send them, it doesn’t take a rocket scientiest to see what is going on. AnnualCreditReport.com and the FTC are in on it, too. The AnnualCreditReport.com site says that just because none of the “identity verifying” questions pertain to you doesn’t mean there’s fraud. The useless FTC claims they just keep track of complaints, but has no enforcement jurisdiction. Instead of enforcing the existing law, the latest credit law Bush made was basically a duplicate law to placate people who have either never lived in this situation or are profitting off of it!

I agree. Maybe if enough of us pee-on slaves get together, some good, brave lawyer will dare to do a contingency class action against Equifax, and maybe Experion, since I think they’re beginning to do this as well.

Equifax is a gang of criminals of white shirts. I wrote several letters to obtain a copy of a credit report they submit to Chase. They NEVER answer my petition. They sent me letters asking me to provide proof of identity which I did in two different occasions (SSCard copy, Drivers License, etc etc) Their answer was “Photocopies are not big enough to see clearly) I finally sent copies 8 1/2 x 11!! and their only answer was that I could obtain a copy by paying “X” amount of money. I do not understand when and how this bunch of outlaws got so much power, and obtained permission to screw our lives with total immunity. Well, what is un_American depends on which side of the $ sign you are on. Equifax, TransUnion etc will tell you they don’t ‘collect’ information. They ‘only record’ that sent to them from whatever lenders you are holding accounts with. They definitely generate sizable profit from that library, from companies and consumers; and secondary echelon of interested parties as well. The return on 2 something billion is around 650 million. Stock price runs about $106. Next I’m googling how many lobbyists they employ. If a groundswell of opter’s-out was to ignite, would that business model collapse? Just try finding a process to opt out of the whole thing. They’ll suggest denying that your lenders supply such information. To me, the crux lies in personal information is being capitalized on, that was never granted but mined endlessly.
Oh, and calls or webaccess solicit a ‘please respond’ survey invitation, without any sort of compensation…

I am in the middle of Suing Equifax for some MAJOR issues they have caused me and my credit! Along with the Finance company they have backing and have refused to correct my report, even though I sent written proof on their company letter head which they take FULL responsibility for the mistake and admit they were supposed to have it corrected a year ago and they still did not fix and remove. They said the finance company says it is a correct report and not to remove it.The finance company says that Equifax never even told them of my dispute, don’t care who is telling the truth they are BOTH going to have to PAY UP!! I hope that my suit brings some long over due ASS WHIPPIN on these corporate, greedy school yard bullies!

They just got me, good credit everywhere until Virgin Mobile tried to upgrade my phone and now cant even get a phone handset. I think what would be useful is if we knew what companies use Equifax here in the UK before it proliferates here. Virgin is one, and LLoyds is another. Anyone else can add? If a list is made and these companies stop using Equifax and use someone else…. I know its not a good thing but the UK Experian has not got court caes against them for fraud and neglect.

Any solicitors out there who could shed some light on a consumers right in the UK with regards to such things.

Equifax exists as a parasite on us, making their living off of us, hoarding our personal information, then don’t properly protect the data. AT&T owes me lots of money and so does Verizon. I got their service and they were making thousands of calls, and expected me to pay for tham. I was only mad calls to my 2 kids. The bills were arriving with $350 per month. The internet from $25 per month to $85 instantly. This people are criminals and our Government allow the criminals to prospare from innocent people and taking their children’s food from their table. Their bad credit to me, means shit! My credit union dont give a shit for bad credit reports. You need money, you get it!
