  By writing the judgment in the way he did it forces the supreme court to consider certain issues in detail, that it would rather avoid, during the appeal.
  
  Looking forwards to the appeal decision becoming an important ruling in case law.

  The big picture here is the fight for control. One of the greatest fears of any government is to lose control of their currency. Image a world where the US dollar ceased to be the medium of exchange. Where a significant proportion of your economy was transacted under a currency over which you had no control and no means of taxing. Yes, a first world economy, with a third would currency.
  
  The greatest danger to these electronic currencies is the wild speculation on their value, fragmentation of the available currencies, and they are still only used by a small minority of people.
  
  Left alone they may well remain a minor player on the global currency market. A curiosity at best.
  
  This kind of bill, rather than hinder, helps electronic currencies. It spreads the word about their existence and it forces them to further develop the tech to get around the bill. That tech makes it more likely that fragmentation would decrease and the value stablise. Stupid legislation forces electronic currency to evolve into something we will all use.

  So they get billions of dollars, spy on everyone, months to investigate, and the best they can come up with is 3 possibilities. Of course, Snowden never acted alone, because that would make them look even more incompetent. Gotta love a spy agency that so rampantly chases the secrets of what your neighbors dog ate for breakfast, but can't keep any of their own.

  Weak sauce I say. How about packing some explosives into the phone as well and make it a real kill switch. That way we could like intercept terrorist's phone calls and kill them before they did any harm!.
  
  Universal ID badges as well. We should make every have one, to be displayed on their clothing at all times. That'd stop those illegals.
  
  And while we are at it, those genetically disposed to be criminals, we should stop them breeding.
  
  And kids walking on my lawn... don't get me started on that.

  On a side issue.

  This is an extreme example where a corporation has all the rights of a citizen, and demands those rights be preserved, and yet takes none of the responsibility of a citizen.
  
  I do believe we need to re-examine what rights a corporation is given. As a citizen, if I break the law, I go to jail. As a corporation, if I break the law, I pay a fine. This is not an equitable outcome.
