I absolutely agree. For someone that knew or should have known exactly what the question being answered was and that degree of involvement there is no excuse for making such an error. This demonstrates once again the arrogant attitude of the industry and might I say the industry as a whole. Clearly a flippant attitude on the part of the Sony Exec (soon to be ex Exec?). Given the severity of the the punishment, and the clear application of the testimony to that decision, a mistrial is certainly in order and action against the Sony puppet warranted.
Seems everyone has jumped to the conclusion that the customer knew that file was on the computer, but I do not see that established anywhere. So, is the technician guilty of viewing child porn by playing the file? Should the technician be arrested and charged? It is obvious that you can't trust any technician to work on your computer without violating your confidentiality. Seems to me the technician/repair shop had an obligation to explain to the customer the process that would be used in sufficient detail to allow the customer to make an informed decision, and determine to what extent he was willing to pay for the service. The irony of this is the the guy probably had to pay for the work that was done, although I would guess grudgingly. It makes you wonder how much other snooping the technician does. What pray tell does playing a video file have to do with testing the operation of a DVD drive? Playing a video file says nothing about whether the drive works or not and contrary to other comments, there is no mention of any software installation so he must of just been wasting the companies time. If and only if the person is guilty of possessing the porn should he be prosecuted, but he should get the max for being so foolish if nothing else, and the tech should go down the road for violoating the customers right to privacy.
And then of course is the question of is it really responding to alcohol or something that it just thinks is alcohol? Even ignition interlock devices are subject to this error, and then of course there is the problem of heavy perfumes or aftershave that have alcohol bases and mouthwash and food. It sounds nice on the surface but much more of an infringement that it is a cure for anything. MADD has a good cause going, however their efforts continually suck attention away from other equally serious problems. They suffer from tunnel vision I think.

I remember when there was such thing as fairness in the use of the public air ways, and it did provide for a balance of information which we certainly do not have now. There needs to be some additional regulation of ownership, as a few major companies owning all of the facilities detracts dramatically from the accuracy and balanced coverage of media broadcasting. Likewise it does nothing to improve the public emergency management announcements to insure there is someone available to actually issue the warnings, as has not been the case in the past. The sooner the better, I say!
Considering the Supreme Court Ruling regarding the freeing up the political advertising funding in a way that is beneficial to the Republicans, I say you have missed the point. I remember what programing was like when the fairness doctrine was in place and it sure as hell was better than the crap we have now.

The point is not that the infamous number was posted and removed but mostly how it was done. Many posts were removed with no notice and in fact there was an appearance of trying to avoid explaining why there was this massive removal of posts. Thats what pissed everyone off, I think.

Think about it, this is not something that has affected one individual wanting to visit from Canada. It is really about everything posted on the web, being on the web and in some server, forever including our posted comments. Just imagine "My Space" never going away. Just imagine your email and this email never going away. That is what it really is about. The people you post anything about them selves on the web affectively give up control of the information. Try doing a Google search of your name, or address, or phone number, or any other little piece of your personal life and see what you find, maybe nothing if your lucky or maybe something you wish you had never written in the first place.
Jack is right. The students simply should be held responsible for their conduct and actions. By the time they reach High School, they should have a concept of responsibility and appropriate conduct. The majority seem to, or is high school really chaotic all the time. For those that do not exhibit appropriate use of their cell phones, dicipline them appropriately. It is unreasonable to punish everyone by denying an otherwise legal activity, for the failure of a few. If they are expected to behave like adults (albeit young adults) then they should be treated as such, and held accountable. It would seem to me the same rules that are in place for the teachers should also be in place for the students in this matter.
