  • Patent Reform Bill Would Curtail Lawsuits Against Those Who Falsely Claim Patent Protection

Re: The original post is somewhat misleading

"To touch on Ravicher's point about misleading the customer"
You need to look at who Ravicher is and who is funding him. As far as I can tell there is nothing public about his enterprise. Since he started the false making situation I expect that there are numerous big companies who are looking at his operation. The fallout should be quite entertaining.

"We value IP privilege protections more than we value protecting against fraud."

If this was true there would not be a law with penalties for false marking.

The companies being hammered for false marking are also patent pirates. Two sides of their ethical leanings.

"Ah, yes, since MS may have violated other patents in the past, that must mean every patent holder that sues them in the future is completely correct and their patent is completely perfect."

    1) Since Microsoft is losing so many cases it means that new claims against them are likely to have merit.

    2) In this case the court has determined that Microsoft is wrong once again.

How do you explain how so many little companies are winning battles against Microsoft? After all, Microsoft has all the resources they need to have their day in court and they are still losing case after case.

Law is not perfect, especially when it is David versus Goliath. When the Davids keep winning in spite of their financial disadvantage that should tell you something.

It is up to chiropractors to prove their claims.

    Is this a BOC shill?

I made the mistake of going to a chiropractor about twenty years ago. She took xrays of me and they came out completely washed out. For readers who do not understand what this means, she exposed me to far too much radiation.

I have come into contact with quite a number of chiropractors over the years and had them try to BS me about what they could do. I think based on these experiences that there are quite a few quacks in the profession.

    Chiropractic Claims Are Bogus

It is my hope that consumer protection agencies worldwide will now take notice of outrageous claims and force Chiropractors to quite claiming that they cane cure auto-immune illnesses and other claims which are not supported by hard evidence. This kind of clampdown would serve the public's interest and it would be poetic justice if such came out of this case.

How Can Mike Masnick Defend Microsoft?

Mike, how can you continue to defend a company like Microsoft when they have been repeatedly caught with their sticky fingers in others patent cookie jar. Have you ever bothered to to actually review any of these cases and seen how atrocious Microsoft's and other members of the Coalition for Patent Piracy & Fairness has been?

Do you know that the threshold to make holding patent thieves accountable is in the ten to one-hundred million range and that below that amount Coalition for Patent Piracy & Fairness members get a free pass to steal. Are you aware that for every high profile case where a member of the Coalition for Patent Piracy & Fairness is held accountable that there are scores of cases where the damages are too low to make enforcement economically viable?

Big companies continue to steal independent and small company patent rights because doing so is profitable.

Microsoft and other large companies have considered Patent Deform legislation. That legislation is designed so that small entities will be able to get patents but will not be able to hold on to them. It is designed to turn the patent system into a kings sport by raising the costs of defending a patent and it is designed to greatly limit the ability of small entities to get contingency representation by lowering the amount of damages when the big entities are caught stealing. While the threshold to economically sue is currently in the ten to one-hundred dollar range Patent Deform would increase the by one to two orders of magnitude.

    Staying in school.

"i quit school because of them and the teachers were happy i quit"

Based on the posters writing I wonder if they are ADD, Dyslexic, Asperger or suffer from some other affliction.

Our brains are complex and different parts do not communicate well with each other. We see a large percentage of these issues in the inventor community.

I have long suspected that some of our brains are wired differently and that is a big factor in the left handed approach which leads to inventors finding new and unexpected solutions to problems.

This also plays a role in people being loners and the fact that they often simply do not fit well in society. Yet it is a fact that these people often go on to produce great things. They are a valuable resource and they need to be protected from majority dictatorships.

Phoebe Prince probably fit this profile and it was the schools responsibility to have protected her. They didn't and now she is dead. That is BS of the worst kind.

    Religious Bullies

Most certainly those who claim to speak for god are often self righteous bullies.

Think about this, it was not that long ago that pious bible thumpers would lynch a black person on Saturday night and go to church on Sunday. In fact, they are still doing this to gays.

    Dealing with bullies

I was asthmatic, scrawny and wore eyeglasses from five on. My interests were not the same as most kids and I was bullied for years.

When I and my parents complained to the principle she said that boys would be boys and I would have to take my lumps like the rest.

In sixth grade I decided I had had enough. By then I was really into science and I took a squirt-gun to school with diluted ammonia. When the bully and his support group stopped me on the way home from school I told him he better leave me alone or he would be sorry.

He shoved me and I squired him in the eyes, kneed him in the most appropriate location and after knocking him down I spent some time jumping on the sob's chest.

The next day the principle called my parents and I in to discuss expelling me. My parents explained that boys will be boys and they would sue the school if they expelled me.

While from time to time some dim wad would threaten me no one dared to lay a hand on me from then on.

From that day on I was defending other kids who were bullied and the bullies knew that I would fix their wagons if they took me on.

That turned out to be great training for becoming an inventor, because big companies are bullies just like we had in school and just like school most people rationalize that the bullies would be allowed free reign.

It is kind of neat that I am doing the same kind of work today which I did then, adjusting bullies attitudes, except today on a much larger playground.

For one reason or another many kids march to a different drummer. They have a right to a good education free of being abused by the knuckleheads.
