Is not given a camera to some monkeys creative?, selecting and editing pictures that they took creative?
Whats the difference between a monkey and a camera self-timer. Would he beable to claim copyright to pictures where he set up a camera self-timer and then threw it in the air at the appropriate time? After selecting and editing the pictures would he not own the copyright?
SO, if I, as a fiction writer, started writing a novel on copyright infringment and used a fictious address for the perpetrators "that is coincidently" just across the road from me, could I sell seats to the insuing Swat team raid....?
Could I store my photographs on Box but name them Thor.avi and Dark_Knight.MP4 Would men in dark suit and sunglasses visit me?
Sounds like misdirection could be a fun game to play with the RIAA.
I think it's more of a case of expectations, as part of an "event" one would expect cameras and media to be there and taking video and photos. If you don't want in the limelight you don't go to the event.
But while walking down a street one does not expect to have their photo taken and there is no way anyone can do anything about it.
