Hm... how is this different from what I wrote? They knowingly crossed the border and were performing the chase, which is, technically, is a perfectly legit police function.
The problem with the prosecution of that case is not that it's somehow okay for punks to get into church and go all creative, it's that how this specific case was blown out of proportion by the court system which used religious norms of 14th century (read the case materials, really) to prosecute behavior in 21st. On top of that a mostly secular country (at least I thought it was before this case) has allowed one particular religion to drive a civil case (it isn't even criminal offense) into what amounts to inquisition at its worst.
Of course, if you are simply trolling for comments, you should ignore all of the above and just keep trolling :)

I'd like this "up to" deal to be a two-way street. If I get speeds "up to 5 Mbps" I'd like to pay for it "up to $50". You know, depending on availability.
I think the truth is in the small print:
The evidence shows that Defendants' actions of storing and distributing Plaintiff's copyrighted works on its servers on behalf of its customers are designed solely for Defendants' and its customers' financial gains.
I.e. by using the copyrighted works for their own financial gains they effectively sailed out of the safe harbor.
Of course one can never be too sure, but I guess if host operator can prove that he had no direct financial interest in operations than he is relatively safe from this kind of trouble. But, I am not a lawyer, so it's just my 2 cents.
Here's my 2 cents.
Make post office work 24 hours, 7 days a week. Schedule parcel deliveries several times a day, so that if a package comes into relay station at 4:54pm it is actually relayed and moved on to the next station as soon as it is processed. Deliver it it the destination at 9pm or 10pm or even 11pm (see: this post). I've seen lines of dozens of people picking up packages at UPS store at 10pm - so give commercial services run for their money. Make Saturday and Sunday deliveries, when UPS and FedEx are asleep. Give me something that has more value than other commercial services. Small businesses work on weekends, they could use it. Lawyers, accountants, geeks and gadget freaks, heck - even regular boring people like me who actually work the same hours UPS is open - we all would appreciate the service that's there for us.
