    don't tell the "subject" they inspired the character (or anyone else). They would have to prove they were the inspiration which would expose themselves to their indiscretions. Which is "not" liable.

    And you can us the "Generalized" search in Google to find all sorts of other cool stuff .... like how to cook meth, make a pipe bomb, or combine normal kitchen chemicals to make explosives. Yes Google is so much different than ISOHunt.

    Intresting

    While this cover international aspects of internet law, This has potential ramifications in interstate internet law. Specifically tax collection. If there is no physical presence in the users state should sales tax be collected for that state? The item was purchased from the servers in state "X" so it seems that sales tax could be collected for all sales in state "X" but not for sales in state "Y" ..... hmmmm

    Its just a matter of time before a "suspect" of a crime sues a news organization, not for liable or defamation, but for the copyright of their story. They'll use the media's own arguments and win. Then news will exist no more. and the world will be good.

    solution to the problem

    Why not just develope games that have excellent replayability and release add-on packs (updates) that present additioanl revenue streams. Relic has done pretty well with the COH and Dawn of War series. You buy they game and either tire of it or buy the next release. If you tire of it you have the option to sell it to the next patron and they buy the add-on.
    Most games have limited replayability and just simply get old. By adding content as "releases" and "add-ons' the companies can enjoy a longer product life cycle while retaining customers.

    While Drew indeed was a royal B*TCH. I'm still not convinced she was the cause of Meagan's death. From what I've read on the case sounds like she was a spoiled little girl that got mad at her mommy.
    Of course there's still no excuse for bullying. Especially when the bully is a good 15 years older than the victim.

    As noted already, are the pictures porn? Of course posting the pictures on MySpace violate thier TOS, but with that exception where the pictures of the girl doing "adult things" or simply of her naked? This is a VERY relevant point (that I'm sure her defense team will point out). If it was an 18 year old taking the same pictures would it also be deemed porn or just nude pictures? Are there porn laws in PA that prohibit nude photography?

    Newspapers with always thrive

    Newspapers are not in any serious trouble. A strong statement, yes. Newspapers are evolving. The good ones. In the news industry information was first relayed via notes scribbled on walls, then pamphlets, newsprint, radio, tv, and now the internet. In order to survive the companies that provide the news MUST adapt to the new medium presented. While no longer "paper", news will always have a market. Adapt people.
    Having government controlled news is most assuredly NOT the solution. At that point it is no longer news but propaganda.

    Gotta change the skill/ chance argument a little guys. While a 40ft putt (golf) does require a LOT of skill, can anyone tell me there is NO luck involved? If luck was not a factor then why compete? Enough practice and a 40 ft putt (or 400Yrd. hole in one) would not be nearly the accommplishment. It all comes down to weither or not money exchanges hands as a result of the outcome.

    You nailed it right there ..... the record industry is the ONLY entity that will suffer from a "new business model" as it doesnt neccessarily have to involve them.
    It used to be a new artist relied on a "label" to promote and distribute physical albums. Now a few hundreds bucks or friend with a half decent studio along with an internet connection and you can be heard by millions .... if you ARE GOOD.
    No longer is the "public" (me) subject to (what some gum eared executive that wants to do a favor for his golf buddy) the crap that has come out of LA.
    Of course there has been many many good artists. Given the current environment it would be intresting to see what kind of label deals these artists would manage.
    Would the labels make as much profit? Doubt it.

    Great point ... McDonalds counter sues for possession of pornographic material (making available to minors). I'm not positive but in good old "Heartland" Arkansas I'd bet that production of pornography is illegal as well. Can i hear the "Indictment" in the air?

    Of course it could also be argued that the employee had to rifle through the phone to determine ownership. This does not preclude the "posting" aspect. Question I have is where did the employee upload the photos? A laptop at the "office", his house? And by "staff" did Phillip Sherman talk to a manager? Assistant Manager? old guy supplimenting his social security check? All relevent.

    Why oh why could I not get called for this jury!

    Free food.

    Growing up in South Alabama I can tell from first hand that what occured in Colorado had little to nothing to do with the economy. In rural communities fresh produce is as common a staple as Starbucks to the Urban survivor.
    Has anyone (reading this) evey ventured to a gas station radio event where something (anything) was given away free. From Bumper stickers to a free t-shirt you will indeed get HUGE lines, even in the strongest Reagan economy.
    The population is responsable for how they fair this economic "slump". I see News coverage of Mr. and Mrs. "smith" loosing their house etc. This early in the game its most assuridly thier inability to live within their means apposed to the fault of the bank. When you live using every cent of your income ANY change will result in severe concequence.

    Whats the problem?

    Many of the comments mention that nudity should not be censored. Right. I'm sure that many of the people that complain walked naked though their house at some point that very day. Risking (not wanting) that someone would see them through a cracked windows or their child would see them. Nudity (I feel) is not the problem, even in this scenario. Its control. People want every one to feel and think the same as they do. This is not only impratical but also immpossible. These people foret they are forcing thier views and ideals on other people. It was a breast (with a pastie) not a live sex show. The content of the rest of the show was way worse in my opinion. Not saying I didn't enjoy it. Rediculous!

    Simple fact .....

    If the movie industry creates valuable content they will make money. People want quality (The Dark Knight). When people get crap (White Chicks) they would probably NEVER watch the movie if they didn''t download it illegally (even in 10 years when it came out on TV and they switched the channel). Every movie I've seen in the past 10 years at a theater have been positivly reviewed by the majority of the "boards". If torrent sites say a movie is crap I don't go to the theater. I don't rent the DVD. I don't get it from Netflix.
    Now given that info, if by chance I did actually get access to an illegal copy and attempted to watch the film (used loosely). Did the theater loose money. Maybe. But at least I didn't waste by 7, 8, 9 $$$ and feel "burned" toward the studio for making such crap.

    Question

    What is the source of this document? Where is it and is it a "real" doc? I hate when an exerpt is posted with no access to the entire publication (document or otherwise). And the lack of a trailing period raises question to its authenticity.
    I'm sure that RIAA, MPAA, BSA has similar agreements with their legal teams. For purposes of documentation they would have to download an entire file to ensure it is actually the file in question. Of course it could be argued that the legal firm would not neccessarily "HAVE" to upload the file (uploads can be turned off entirely on most programs).
