Since when has the merit of a case had complete bearing on summary judgements? The two are not mutually exclusive. And in this instance I do not believe the party bringing the case matters, just the original and the fair use. Couldnt Hoehn just ask for a fair use summary judgement, i think he may have merit to ask, if it turns out to be needed?

wait, i cant read french, so may not have been on the same site. And they were third party marks like shutterstock, it doesnt look like canoe marks any of theirs. But they have credited/copyrighted the photo and the article in that space on many articles, still leaning me towards: that mark is standard and not intended for the picture.
if you go to the story, and right click on the image, and select "view image". There is no copyright. On most every image that has a claimed copyright, that mark is part of the image.
ehh, nor is my spelling.
oh and the first point is valid, their funding is probably still being allocated poorly. But, lots of the funding has been cut compared to the past few years.
