I think government should acknowledge anything can go viral. Treat all FOIA requests as if they were about to go viral and just do the right thing. But we have a culture of secrecy in government based on wrong doing and fear of exposure. So everything gets classified.
The phone is contract law where you agree to pay for calls made on your line. The other is Civil or Criminal law. In civil and criminal law you have to find the person responsible not just blame a random person.
So what you are saying is, if someone borrows a hammer from you and murders his wife with it, you are responsible for the murder. That just doesn't make sense.

- If you delete the last back up of a human mind is that murder?
- If you delete an AI that has human like intelligence is that murder?
- If you have a back up of your mind, can the police get a search warrant to go through it?
- How do you handle copyright on music, video, and books in backups of human minds?
That is already killing the record labels, and will kill the Movie and TV studios.
How about a plugin that hits up random web sites and does random google searches in the back ground. Fill up their data set with so much noise they would never be able to tell what you are actually doing.

How do you DRM or make something illegal that anyone can manufacture or modify? Arresting an 80 year old for making golf balls is not going to go over well.
