Please provide a link to this report.
He has, you can find the document here. Read it and weep how some people can't understand that a senate report can contain multiple sections. The document is mostly about telecommunications, broadcast and cable with some sections touching on the internet plus the 230 final draft. He thinks the whole document is about section 230 which is why he is rambling about companies being common carriers just because it was mentioned in the other sections. Matty did the same, neither of them has any reading comprehension worth a damn.

Do you even understand context? Do you ever read more than the tidbit you think proves your point? Did you really think the document only pertained to section 230? Lets list what part that quote belongs to: Subtitle B--Special Provisions Concerning Bell Operating Companies * Sec. 151. Bell operating company provisions. * * SEC. 274. ELECTRONIC PUBLISHING BY BELL OPERATING COMPANIES. * * * (h) Definition of Electronic Publishing * * * * (2) Exceptions.--The term `electronic publishing' shall not include the following services: * * * * * (O) Video programming or full motion video entertainment on demand. You should get your own theme song about being wrong.

  • Sir, This Is A Supreme Court (Not A Wendy’s)

    Rocky ( profile ), 27 Feb, 2024 @ 03:35pm

You want a place where people won’t tell you, “This is a Wendy’s?” You don’t need a social media site. You can make your own simple website or use a social media website that accepts your speech (such as TWITTER or a Mastodon fork, like TRUTH SOCIAL). WordPress exists. Neocities exists. Hugo exists. You don’t need to learn HTML: Markdown exists.
E-mail and mail-groups exists... It has never been easier to communicate with others, and some people think that means "Ohh, captive audience!"

Let me quote the relevant part you don't understand: 47 U.S. Code § 230 (c) * (1)Treatment of publisher or speaker No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider. So let me spell it out for you in terms an average person can understand: Yes, an internet service is a publisher if it acts like one, but it isn't legally treated as one if it publishes speech made by someone else because the legal burden of being the publisher falls on that specific "someone else". Do you get the last part? Perhaps I should make it even more succinct: An internet service, for example a social media platform, is a publisher but isn't legally treated as one for other people's speech they publish. You have boasted how you are smarter than everyone here while being unable to understand this simple distinction for a very long time. Can you understand that there is a distinction of what something actually is and what it is legally treated as by law?

  • Protect Yourself From Sen. Mike Lee’s Anti-Porn PROTECT Act

It's funny that he uses a definition coming from a quote attributed to Benito Mussolini, a quote that is not historically documented anywhere and yet it started spreading on the internet in the early 2000's. My guess it's originally from someone who badly summarized something they didn't understand from a treatise Mussolini wrote on fascism. And it gets even funnier, it directly contradicts Mussolini's view of fascism which he expressed in several of his treatises. The problem with quotes on the Internet is that you can never tell if they're genuine. - Abraham Lincoln

  • The Right To Advertise?

    Rocky ( profile ), 26 Feb, 2024 @ 12:13pm

The "case" won't work because a mall isn't a service, it's a physical place where the public can walk around and access a multitude of businesses/services. Pruneyard case-law says that only the places designated by the mall-owner can be used for speech and those who are speaking must conduct themselves in a manner that doesn't disturb the mall's peace, patrons and businesses. If people want to apply Pruneyard to social media, they can go ahead, but they won't like the results since it doesn't actually mean they can say whatever they want wherever they want. They kinda gloss over that part of the case.

  • The Right To Advertise?

    Rocky ( profile ), 26 Feb, 2024 @ 09:13am

Let me demolish your idiotic argument here. Do you know what else don't have affirmative editorial discretion? Syndicated ads on sites. Are the site owners powerless to remove such ads because it would constitute "viewpoint discrimination"? How does it feel not to possess one iota of logic and reason?

  • The Right To Advertise?

    Rocky ( profile ), 26 Feb, 2024 @ 07:10am

It's interesting how disingenuously they use the phrase "open-access" when in reality you can't use a social media service without accepting a TOS/AUP and were the service reserves the right to decide what is acceptable. Just like how you can't place an ad in newsprint without first accepting a TOS/AUP and were the editor/news-org reserves the right to decide what is acceptable. They are intentionally conflating "open-access" with "open-use" to muddy the waters, ie almost all social media allows open-access so the general public can read posts without logging in, there are some small social media sites that allows "open-use" as in posting anonymously or without accepting a TOS/AUP, but there is no social media with a larger userbase that allows that.

  • Social Media Isn’t A Shopping Mall

    Rocky ( profile ), 23 Feb, 2024 @ 02:59pm

As it was said, you don't get it and you don't understand the word no. And it's people like you that threatens free speech for everyone else since your actions objectively limits free speech in the long run. You have stated your dissent, everyone here have seen it repeatedly and told you to take a hike because no one here is going to change their mind seeing your drivel. You have long passed the point of being someone who voices his dissent, now you are just a harasser too stupid to understand you have outstayed your welcome while possibly scaring away new users. And what is the solution to deal with harassers? You limit what people can do and say in an effort to get rid of the harassers - ie people like you, which ultimately affects everyone else in a negative way, like less opportunities for speech. What kind of morals do you have when you abuse a system meant to let people post anonymously? Your weak excuse of "the owner lets me post anonymously" flies in the face of him asking you to leave. Tell us, whose fault would it be if Mike stopped allowing anonymous postings here on TD because you didn't understand something as simple as "you aren't welcome here"? Assholes always make the world worse for everyone else.

  • Social Media Isn’t A Shopping Mall

    Rocky ( profile ), 23 Feb, 2024 @ 08:04am

So if Mike get so fucking tired of your shit and stops allowing anonymous posting, you have then singlehandedly silenced everyone else who wanted to post anonymously. The consequence of your behavior is that it limits the speech of others in the end, just like how every moderation rule instituted is the result of assholes like you who lack any kind of social aptitude and reason, ie assholes. You talk about "moral obligations" while ignoring a very basic moral obligation, respect other people's wishes when you are on their property. The size of the property doesn't actually matter because it's not your property and you are just a guest and yet you persists on taking a metaphorical shit on the floor. Of course, you will never understand any of this even in the face of the overwhelming evidence that everyone thinks you are a fucking hateful loon. They don't want you around, they don't want to associate with you and they certainly don't want to hear your stupid shit. In short, you have made yourself persona non grata everywhere and are likely responsible for new moderation rules here and there.

  • Social Media Isn’t A Shopping Mall

    Rocky ( profile ), 22 Feb, 2024 @ 12:06pm

Pruneyard established that very specific parts of a mall are what we can colloquially call “free speech zones”.
I believe it's even narrower than that, because it doesn't allow you to stand there with a megaphone saying whatever you want to passerby's since you aren't allowed to interfere/disturb other visitors to the mall or its businesses. I'm not even sure you are allowed to approach passerby's considering how much they have narrowed Pruneyard down.

  • Wyden: Data Broker Used Abortion Clinic Visitor Location Data To Help Send Targeted Misinformation To Vulnerable Women

It's almost like he is totally disconnected from reality, because how the fuck could someone miss the whole thing with Kate Cox suing Texas in December to get an abortion? I guess the right-wing news didn't report on that one. Plus, who the fuck want to consult with lawyers in medical matters? Because that is the reality in the states that banned abortion. I think Mr Revenge Porn Douchbag has a preggo-fetish after exploiting women for money in the worst way possible.

Why do you want to lie and dissuade women from getting factual information and accurate medical advice from actual medical professionals? Here's a thought for you, why don't you move to a patriarchal theocracy - they'll really like your views on women as chattel. If you are lucky, you might even get to marry some child-brides you can breed to your hearts content. Nutcase.

2023 was the year Disney favored quantity over quality, most of the movies were kind of bland and not particularly engaging - ie they didn't live up to the standards set by past successes.
