"In Goldman's case, he's actually been "paying" Scribd by providing it with valuable, sought-after content that he uploads. Scribd is "paying" Goldman with free hosting, bandwidth and services. Advertisers are "paying" Scribd with money. Users are "paying" Scribd with their attention."
You can build a house with cards, but you can't start to cater to, e.g., the diamonds, without endangering the whole structure.
Not to mention the fact that it's a lot harder to do 'Hollywood Accounting' if you're merely distributing a film.
"Can you copyright a design? I mean, you can't copyright a book title, can you?"
No, you can't. You might be able to trademark a phrase and then use it as a title, which is where the 'confusion' or 'counterfeit' complaint would surface. It'd be a hard row to hoe, given the multiple examples of different authors using the same titles.
Not sure what this example was intended to show. I'll have to listen to the whole thing (I caught part of it on the air.)
...on her t-shirt (must preview.)
Careful. I've actually seen a girl with the iphone "swipe to unlock" symbol.
7) Your ISP deems this 'providing a service' and shuts you down.

Translation: "I'm giving you an out to go against these people who are threatening my business model by conflating them with people who are going against your political shenanigans."
Hrm. Why isn't a "croissant" a hate crime? Or a terrorist act?
Imagine if they did a swastika pastry these days.
What are you talking about? I no home viewing covered by the patent.
"And even I don't think Apple is so crafty as to issue the takedown just to get the ad more attention."
It doesn't seem like their style, but they are certainly crafty enough to pull that sort of thing off if they chose.
This is why you have multiple carriers, Apple. *hint*
If by 'sane' you mean 'the industries' wishes' then yes.
Otherwise you're shit out of luck.
Every rightsholder should issue a takedown whenever any politician tries to use something. Maybe *then* they'll get it.
Or what if you're looking for the church, and you end up in the restaurant? THINK OF THE SOULS!
It's an outline of a bat. To promote a restaurant. Yes, it looks vaguely like the outline of a bat to promote a comic book. Not an issue (pardon the pun.)
The capriciousness of our legal system aside, the real factor here is that DC has a team of lawyers and BaTs does not.
Disgusting.
Home taping killed music. What we have now is ZOMBIE MUSIC!
"There are bad patents but obtaining them is not as easy as you think."
What point do you think you're making, exactly?
Somewhat buried lede
"... when another Senator asked why they didn't ban dial phones from all of Washington DC, Senator Carter Glass from Virginia who sponsored the revolution apparently said that "he hoped the phone company would take the hint," and would remove all dial phones. "
I'm amazed at the restraint they thought was appropriate.
