Taiwanese Court Says File Sharing Software Perfectly Legal

While the commentary on the US Supreme Court’s ruling on Grokster keeps on coming, it’s important to remember that the ruling just covers the US. Over in Taiwan, a court has ruled that a similar file sharing system is completely legal. The court points out, first, that there aren’t any Taiwanese laws that prohibit file sharing, and second, that in not actually distributing the files themselves, the software shouldn’t be held responsible. Of course, like the US, where lower courts made the same argument on Grokster, this one will get appealed higher — and you can bet the entertainment industry will take some of the findings from the Supreme Court ruling on Grokster and use them again.
