Fair use – 17 USC Section 107 is affirmative defense to a claim of copyright infringement, meaning that content users have to prove the fair use against the claim.
WIPO broadcasting treaty and TPP secret negotiations on new copyrights could be concluded in 2015.
According to the WIPO, new rights e.g. post-fixation rules would apply regardless of whether the content was in the public domain or whether a fair use argument applies.
The draft also includes rights management information like broadcast flag that was eliminated officially by FCC in August 2011 because of exceeding its authority in creating this rule.

How to prove fair use
Once again, fair use – 17 USC Section 107 is an affirmative defense to a claim of copyright infringement, meaning that content users have to prove the fair use against the claim.
There are some ways to prove the fair use.
As one of the examples, if eff.org puts the fair use server on the Internet, consumers are allowed to transform themselves into provable fair users to re-transmit the free over-the-air broadcast via internet.
The fair use server provides a higher order solution that protects copyright while executing fair use, meaning that cybersecurity and cyberfreedom aren’t trade-offs.
