Court Says No On Aimster, Junk Fax Cases

The Supreme Court turned down appeals on two different tech related cases today. Both of which were probably good decisions. First, they refused to hear the appeal on the Aimster case, concerning the file sharing program that was shut down by a judge. While the initial ruling doesn’t necessarily make sense compared to very different rulings concerning programs like Morpheus and Grokster, the Aimster case had a few specific factors that probably make it bad for precedent setting. At some point, a similar case will eventually reach the Supreme Court – but with a better set of facts backing it. The second appeal the court refused to hear was on a First Amendment challenge to the law banning junk faxes. This means that the law stands as is, and the FTC can continue to unsuccessfully try to shut down Fax.com.
