Dutch Workers Can't Be Sacked For Porn – Without A Policy In Place

While there have been plenty of stories of workers fired for having pornography on their office computers – or for sending it around via email – a Dutch court has now said that employees can’t be fired for such actions without a written policy. This makes sense. If a company is going to fire people for such actions, then it’s only fair for them to let employees know ahead of time what is and is not acceptable. The article also mentions that some new European regulations will prohibit continuous monitoring of employee computer use without a good reason.

Not too different here

That is pretty much standard practice in the U.S. as well – if there is no written policy against it (and it isn’t illegal), then employers can’t fire you “for cause”. However, most states have “at will” so an employer can get rid of you for any business reason, so realistically an employer in the U.S. could use another reason, the difference being you could collect umeployment for being restuctured from your job and not if you are fired for cause.
