Suing DoubleClick Over Misleading Internet Ads

In a case that sounds remarkably similar to one filed last year, someone is suing Doubleclick for putting up banner and pop-up ads that look like Windows error messages to trick people into clicking. The claim, of course, is that these ads are misleading and constitute fraud, though I’m wondering how it’s “fraud” unless the person felt compelled to actually buy something. In the meantime, the older case was settled out of court with the advertising firm not having to pay anything, so it doesn’t look like this case has much going for it.
