NextWave Wins Battle For Spectrum

The Supreme Court today finally ended the NextWave/FCC license debacle by saying that the FCC was out of line in taking back the spectrum they sold NextWave. Now, what’s left of NextWave can get on with selling licenses to the spectrum they own. The case has been a big mess from day one, though it has raised a number of important questions about how the government sells spectrum. The more important thing, for those in the industry now, though, is that this spectrum that has been tied up in legal battles for so many years, now has the opportunity to be used.
