Verizon Wireless Also Pretends Customers Don't Know What Unlimited Means

I've been testing out Verizon Wireless' EVDO service the last few weeks while traveling to a variety of places around the country. I'll write up a more thorough review later, but overall it's been very good. However, I'm disappointed to find out that it appears Verizon Wireless is taking after its parent Verizon by pretending people don't know what the word "unlimited" means. The service, which is very clearly marketed as being "unlimited" turns out to be extremely limited, with one user getting kicked off after Verizon Wireless decided that he used his "unlimited" connection too much. It's back to the days of fuzzy caps. Now, obviously, there is limited bandwidth on the network, and bandwidth hogs can be a problem. However, if that's the case then the company shouldn't promise an unlimited service it can't deliver. That's false advertising, plain and simple. Of course, this shouldn't come as a huge surprise to those who have read the fairly draconian terms of service Verizon Wireless offers with its EVDO card where the definition of "unlimited" appears to be very, very limited. Still, it seems that if you're advertising unlimited service in huge fonts on the front page of your service, you really shouldn't be able to get away with redefining a very common term in the fine print, and then arbitrarily cutting people off.

Yeah, how is this different from any other marketing? They're allowed to say whatever the fuck they want in advertisments, so long as they tell the truth "clearly" in the fine print.
Look at rebates and whatnot. This computer is $200! Oh, psst, that's after a mail-in rebate for $4800.

So far it's been pretty good and I use it all the time. My only complaint is a big service hole right over my town of Playa del Rey. What can you expect when you live in the boonies, though, honestly? ;-)

You can't sue them because you signed a contract with an arbitration clause and one that said you can't arbitrate as a class. That makes it unlikely that you would arbitrate for $100.00 wen an arbitration costs $3000.00 up front.

Isn't it possible to show that such and arbitration clause is unenforceable. I believe that courts have ruled that the 3,000 must be paid by the company if it wants to enforce the arbotration clause because the the filing fees in federal courts or state courts are substantially lower than the arbitration fees

My account was unceremoniously terminated this morning after my usage exceeded 10 gigabytes during a 30 day period. Verizon determined that this bandwidth "could only have been attained by activities such as streaming or downloading movies and/or video", which is a violation of the usage agreement. Actually, I explained that I generated this traffic by using Timbuktu, a remote desktop application which lets me virtually sit at my office computer. They refused to acknowledge this as being legitimate usage. Verizon doesn't seem to care how you use the bandwidth - they just don't want you using it!

You also don't get a whole lot of warning. I received my letter indicating termination on the 22 on the 19th!

I got cancelled on the same day with the same letter. It sounds like your usage was legitimate. I was blatantly downloading videos all night. I chatted with spint and they literally said I could use their card however I want. I'm still looking for the terms of service so I can make sure. I don't want to have to sell two cards on ebay.

The same thing happened to me!
No warning, no investigation -- just crazy backwards-day kafka-land
- letter of termination sent 1 day prior to termination of service.
- talked to customer service to purchase new service, they claimed I could watch vids and listen to streaming audio, as well as keep my computer connected 24/7 - as we all know, violations of BS-TOC.
This must stop!

Agh, scary. I just switched to Verizon from Cingular for better coverage. I had the unlimited with Cingular and downloaded a great deal just checking work emails. I never looked at streaming video or those downloads, but if my usage holds correct the Verizon folks shall be unhappy. Since I have a business account this could get interesting...

I have had the EXACT same problem with my supposedly-unlimited Verizon wireless broadband. I was using it for working remotely, and used a remote PC administration tool to access my machine at work.
Has anyone tried returning the card and cancelling their contract? The rep on the phone was completely useless, basically told me that all I could do was go to store where I bought it. This should be interesting....

The thing about it is verizon will make money by selling the card and then terminate the service in six mounth for over usage .This company is full of SHIT. Will never use them again. I could not believe my eyes when I saw the letter today. When I called them and asked "where is the warning?", the rep says to me "Do you ever get a warning from a police officer when you run a red light?". I replied, "Yes, I have!". She says, "Well, not here in Georgia you don't!"
Anyway, it was stated to me that there was NOTHING that could stop the termination. I was transferred to a manager's voicemail and left a message there. I do not expect a return call anytime soon, because Verizon SUCKS!

i just bought my card and got online and read this and now im afriad to play my online games. i bought this card strictly for playing my online games on the go and now they are going to limit it. i can use up to 10 gig in a matter of 5-6 days playing my games. i kno itll be coming soon. but if i terminate my service now ill still have to pay the 175$ so might as well wait for them to terminate me.
when they do tho ill go to the place i bought this and tell them off becuase i told them what i was going to use this card for and they said i would be fine and that the speed would be good enough.
the speed isnt really that bad im happy with the service but shit ide like to be told b4 i buy this that its "limited" and that i have a certian ammount of space b4 they boot me off the plan.
+ i didnt see ne where in the store where it said "limited". so they want u to buy it. than read the licence. but when u buy it ur in the hole ne way. because ur not going to buy a card w/o the service.
this si really alot of shit. why would they terminate someones acct when they pay 70-80 bux a month. why do they want to make the quick $. ide think they would value my service and my money over time. ide pay more for the service than i would to be terminated.

Get this... I was cancelled today for downloading too much data, and called to complain, and left a voicemail for a supervisor to call me, SOMEDAY..
However..... After calling back today for the fourth time trying to get a supervisor on the phone, the rep I was talking to says.. it would probably be easier for you to just call in to our sales department and order new service.
HUH ????????
So, I called back to the sales dept. and said.. I was cancelled today and it looks like I need to start new service, and the rep says... OK !! assigns me a new phone numer to my Wi Fi card, and signs me up. 8 minutes later, I am back ONLINE and charged a $ 25.00 activation fee.
Why do they bother?????
( I do think that a class-action suit could be brought against them because they do not provide a way to track how much data you download)

First, a person always retains the right to litigate anything regardless of fine print waivers. This is shown by countless class action suits when such agreements were in place. Other than the SEC that requires its members to arbitration as a matter of license, they also have the option to use the courts.
My service was also cancelled this week and I now know the fine line between unlimited access and bandwidth transfer. Their marketing was betting that unlimited access would be synonymous with data transfer and for the most part, the misleading wording hasn’t been contested.
They waived the termination fee which if charged would have landed them in small claims with the lengthy request from me of:
• Accounting of data transfers by IP address and times
• Actual impact to their networks correlating to those times
Since this would be a request by me for a court action, they would have to comply.
Here is the kicker. I get these cards through my employer account and they send them for free. They cancelled my account and gave me an attitude. While I am on the phone with their security customer support mis-representative, I am ordering another $200 card for free with free shipping on-line. Ummmmm, OK, I’m wounded; you just sent me a free $200 product with 3 days down time total.
I’m drawing a letter to the FTC and the BBB for false advertising. I’m also sending a copy to their corporate offices. If there are any attorneys, you could probably make it easier by contacting me to get the class action ball rolling at eddiedrago@hotmail.com . If not, I will be contacting attorneys as time permits.

My service is in Hawaii. I'm not getting terminated sights are not loading are and takeing for ever to even refresh. The system goes dorment. Vz tells me its ventura and tells me to up date it to a better ventura. it got worse. This has been going on since I started the nonservice. I have been experiencing slow service all over the U.S. Where are the Europieans when you need them?

So it sounds like I can get out of a contract without paying the early service termination fee simply by downloading a few large linux distributions?
Let's see. So I get the Samsung SCH-i730 PDA with Windows Mobile, Wi-Fi, bluetooth for $200 with no rebates. Then I plug it in and set it up to download (and discard) data as fast as it can until it runs over the limit.
They terminate service, I don't have to pay the service termination fee, and I don't have to return the phone since they can't prove that I violated the terms of their contract. They would be terminating it under the clause that it "adversely" affects their network, at best.
So I get a pretty decent PDA with wifi and bluetooth for $200.
The motorola Q is $100 if you can turn in the $100 rebate. It has Windows Mobile 5, and a 1.3Mpixel camera.
Sounds like they're creating an expensive loophole by not specifying the limits to the unlimited service, and not providing detailed data logging and accounting.
But I'm quite happy with my xv6700 and phone service, so I won't be taking them up on their "offer" anytime soon. An enterprising individual could make a bit of money on ebay...

I got my service about 6 months ago. At the time I went into one of their stores and they gave me this wonderful pitch about oh yes if you have a current cell phone account with us it's only about $60 a month and you get unlimited access for whatever you need. They pumped it all up and made it sound like a great thing...I even got it without the broadband speed available since the rep told me that it was coming soon I could bare with the slower speed for a while.
Then about a month ago I was so happy they upped the connection speed to broadband. This was only after several calls and no resolution as to why my connection went down for a whole day.
Then this just happened yesterday...while I was in the middle of an important update to my website they dropped my connection. And my connection had been dropping every 15 minutes for about the last 10 hours.
I tried to log back in this time only to get a message that my name and password were no longer on the domain. So I called support went through 3 channels of people to have the last one tell me I violated the terms of service and that my account was cancelled. She even nicely went through and read the little statement at the bottom of the terms of service.
And I was like hmm...that is great, but that's not exactly what your sales rep told me when he sold me the service. He said I had unlimited access and I could pretty much do anything one of those land lines could do.
And then I proceeded to tell them it would have been nice to have be notified that I was "abusing" bandwidth. I could have moderated my usage if I had been informed. Instead of calling, emailing, or writing me a letter you just dropped my service.
Then they had the odacity to tell me if I wanted my service back up I would have to set up a new account with a new number and incur service charge.
And I'm like what!? So I'm royally annoyed and now have this $250 useless piece of paperweight wireless card.
Seriously, if you are going to advertise UNLIMITED there should be no restriction clause.
How did the lady tell me on the phone her definition of unlimited was...something like limited use to check things like email, updating files, and minor stuff...that's limited usage not unlimited usage.
Well I for one will not be returning to Verizon. If they were looking for more customers this doesn't help their customer base. Everyone is pushing for everything to go wireless anyways and eventually everything will be wireless and Verizon just lost themselves a great customer for the future. All because they couldn't nicely communicate with the customer prior to cutting them off abruptly.

I am getting DATA charges on top of my "unlimited" fee of $79.99. They stated that I connected on a dial-up which is slower and they charge a fee for this... Why would I do that?? I don't even have a phone line at my house...which is the only place I use it. If this isn't the biggest bunch of shit, I don't know what is... oh yeah... they also said I renewed my contract in December of last year and in order to cancel they will charge me $175.00 early temrination fee. I DID NOT re-sign with them. I told them to send me the signed contract.... Yeah, I bet I won't see that anytime soon!

This happens all the time..In 2004 when the company was changing billing platforms from CMIS to i2k/vision NUMERIOUS cst had service halted because of poor or inaccurate financial records- once an acct. had a returned check the data base never removed the amount(once payed) I worked directly with 20 to 30 cst who's server was disco'ed- restored then came in the next am to find all the lines disc.!!! Some of the effected csts. lost there Bus. lines-many had been with the company for 3- years..Great service with NO LEGAL regaurd to the Cst....

It's just poor business practice...to can a customer and not notify them. A warning would be nice...then can me if I abuse...but just to can me. That's not good business practice. And the website I was working on was full of audio files for a church that I was moving servers. It totalled about 7GB...so tell me I shouldn't be pissed off?

Verizon admits that they took $538.00 out of my account AFTER it was closed. In our last conversation they said they would send the check in 60 days! This shit has been going on since the middle of December 2006!!!

I am so glad that I came across this, as I just had the same problem! I have a palm treo 650 for the second time! It will not stop crashing, freezing, you name it. I called the insurance company you spoke of, after going to my verizon store a dozen times & having them say it wasn't their fault. I today was on the phone for 2 hrs, with 2 insurance companies..one for malfunctions & one for the actual software..with verizon 800 in the middle. I swear I told my story a million times, and they told me that if I didn't do the hard reset correctly with the tech. When I return it, if he can get it working that they will bill me for the full amount of the new phone!!! Which is under warranty & insured. Verizon service couldn't be any more rude, and they kept saying ARE YOU SURE YOU ARE DOING IT RIGHT MA'AM..well I am pretty sure that I Know how to push a freaking button & take my battery out..All in all, they acknowledged nothing but problems with the 650 but will not upgrade or even consider a price difference. As that is all the insurance & warranty will consider replacing...but for $50 dollars off when the 1st year of my contract is over, I can purchase a newer version..I hate them...

I'm just curious why this is even a topic of concern. The people that get mad about this stuff are usually the people doing things they aren't supposed to. Thus, advertisers have to also put up stupid disclaimers for those of us that are testing the limits. Such as "DO NOT ATTEMPT - PERFORMED ON A CLOSED PROFESSIONAL TRACK" in most all car commercials. Or, on a box of toothpaste, do not injest because can cause illness or death. Or cigarettes and their disclaimers, etc.
Think about that for a minute and stop whining about these things. If you aren't intending to go out and setup a file sharing port then I have yet to know of someone that has been kicked off for valid surfing. There is several things that are considered in this. Not just the kb useage. I dislike when incorrect info incites people to go off on tangents. This is what we did to our world folks. Quit blaming everyone else and work within the normal guidelines of the law and you stay out of prison. Doesn't mean we have to post that you are a free man until you commit murder. Just means it's the law and you should know it. A wireless contract is the law and you signed and agreed to it. So, before you sign something, consider understanding it and take the responsiblity for your own actions. I swear, most every other posting for cellular is clearly the consumer didn't read or ask questions. YOU ARE RESPONSIBLE BEFORE YOU SIGN YOUR NAME AND AGREE TO A CONTRACT. Do you think that a music artist could say, hey my manager didn't tell me that so I want out of my contract? Nope, no court in America would let the artist out. We are responsible for our own actions. So, in summary quit whining and protect yourself by reading. Of all of you that complain about everything. Let me ask you how many positive things you've said about the good companies you've dealt with? I post both online. Not many people do. Take a look at most of the complaints. They are clearly people not reading, not asking. Then whining when it's not in their favor. You get everything you want up front. The wireless giants get theirs over the course of 2 years. Period.

Do you know who the most satisfied customers are? It is not the ones who have never had a problem. It is the ones who had a problem and the company resolved it for them.
Do not give your money to Verizon. I recently signed up for broadband data service with them. I didn't like the service so i cancelled it within the "Test Drive" period they are always talking about in their commercials.
But Verizon kept sending me bills even though I didn't even have the broadband card anymore. It took THREE trips to they store where i bought it originally before they finally said I have to pay for the first month. WHAT?
They said that if i had transferred my service toa competitor then they waive the first month but i just cancelled it so i have to pay. WHAT? So i should have given my money to their competitors and i'm rewarded for that??
Well maybe Verizon did get it right afterall. The tmobile cell phone contracts for my girlfriend and me are about to expire ina couple months. Verizon costs more than tmobile but i thought it might be worth it for better service. So i guess i should thank Verizon. They get my $89 but the thousands of dollars that I will spend on cell phone service over my lifetime will be given to the competition.
Do not sign up for service with Verison. you will be sorry.

Every 20 minutes or so, it disconnects itself.
After being plugged in my computer for long periods of time, the USB connector is already bent, because of the weight of the card itself.

Verizon gave us a royal runaround - after we finally found their number & got thru, but did fix this matter. Then Suddenly we were informed by friends calling other friends or coming to the house to check on us, that our service had been cut off WITHOUT LETTING US KNOW. WE OWED $120!!! When we finally got to talk to someone, we were told it was "all a mistake" & shouldn't have happened. I am 75yo with a heart condition; my husband is 74, & his mother who lives out of state is 95. Gee, are you surprised that we are looking to find a different & possibly more efficient phone company? How about spending less on your commercials, & more on improving service!!!! 703 361-4757

Funny, I thought slavery was abolished a while ago in this country. Wrong! We are being enslaved by our wireless telephone "service" providers. Once they have you hooked, with endless assurances about how easy it is to change plans any time you want. Forgetaboutit!!! Yes, easy anough to change if your needs change...at the expense of siging on for additional multi year service contracts. How can they do this and keep customers? Because once you're hooked your hooked! I've been trying to figure out how to decrease my plan. The only optiona are to pay an early termination fee or extend my "service agreement" read "indentured servitude" agreement by an additional year. Where is the lawsuit that wades into the dense lawyer's language of their contract and helps to extricate hapless, helpless customers?

I received a reminder from Verizon ragarding my 2-year contract will expired within 2 months . I came to an indirect dealer in San Jose to upgrade my equipments. Store manager tried to talk me into signing new contract to get latest equipments with promotion for free activation fee of $35 per equipments. After we accepted his offer, he said we have to pay $25 per equipment for sales tax. He charged me $75 for Chocolate equipment and charged my sister $150 for 2 Chocolate equipments and $105 for latest one. He asked us to pay cash, and gave a receipt to me, but he did not give a receipt to my sister. 20 minutes later, I found that he did not cancel my old account before we signed new 2-year contract, I came in and requested to cancel new account. He said if we kept our new account he would credit us $250. This amount will show on our first bill from Verizon. Four days ago, I got my first bill and bill shows $140 activation fees for 4 phone line. 2 days later I called Verizon Rep. and lady recommended me to return new equipments and get money back. It took me 5 trips to his store, and finally he said he would charge us $70 restocking fee per equipments and refused to pay me back. I called Verizon Rep. and asked her to talk to him but he refused to speak to her. I strongly believe that we were duped by him. I am wondering what I should do to get my money back. Do you have any idea?

Who do I contact after been treated unfairly by wireless service. I just joined with a wireless service a month ago, and paid a lot of money for new service; got the run around once I got the new phone service. This new service phone did not provide the service the company said it would, after getting some run around, they then said I had to get another phone to get the service I wanted but first I had to buy another kind of phone. So, I paid more money for another phone with same wireless service. After paying my first bill, which was very expensive and paying for another phone, they email me a day later saying they were going out of business. They said they did not know if I was going to be refunded for phone I purchase, which I paid for with a dept card. In addition, this was a 2-year contract deal. They also, said I had to fine another wireless service. Now this mean I will have to fine me a new service, pay all over again for activations free, and I have a phone that will not work with any other wireless service. But get this, I had not read the email about the wireless service ending, until late this evening, so when I was buying this new phone with a dept card over the phone, they knew of service ending, but still sold me the second phone anyway, a phone I cannot use with other wireless service. Not to mention all the money I will have to pay for new service.

I was a customer for about 2 years, paying a bill of roughly $65 every month.
Out of the blue I get a bill for $350+. Totally shocked, I paid my usual amount and sent in a letter asking about it. Next month's bill was over $450.
Over the next two months it was back and forth about me, trying to explain that I couldn't have made the "Data" charges they claimed that I did, and them telling me to pay up, and tacking on a different fee every month, even though my service was still disconnected.
Add a couple of months and they forwarded my fraudulent debt to collection agentcies. More then poor customer service, they're violating many state and federal laws, and now stepping into credit fraud.
It's still not resolved, now being about 6 months later and I have filed a complaint with a local government agentcy. They gave my phone number to someone else.
Now what the hell do I do?

I have not liked Verizon for a long time and this only gives me more of a reason to dislike them. I have had Congular for over 2 years now and never seen a charge for something that didn't happen. Plus, although I pay for kilobyte, it is reasonable enough that I can get on when I absolutely have to without having to break the bank. Also Verizon has the most backwards menus I have ever seen. Plus, Verizon loves to lock out features so I can't transfer anything to friends. In contrast my Sony Ericsson's only difference from the unlocked version is that the web browser automatically directs me to the AT&T store and since I use Opera Mini (I can tranfer from my computer for free) I don't even have to see their website anyway. I have never suggested Verizon to anyone and I never will.

I must say anonymous coward, I love the name because that is what you are, if you dislike the service so much at this point you should just cancel and get on with your life. Verizon provides every customer with a copy of the contract as well as making it available online, and can you believe it at no cost. For crying out loud you have been ranting and raving for over two years your contract is up get over it and get off the network you are the type of person who will always find something wrong with a wireless provider because you have no other life. If you think something is wrong with your bill prove it. If there are fraudlent calls show that you have not dialed those numbers on any previous bills. If you don't want to put in the work to get what you want then stop bitching about it because there is not a damn thing that will change because you are lazy

I foresee a HUGE class-action lawsuit based onn factors more ethically important that just misleading advertising. For starters, let's try conspiracy. She DIDN'T download anything and promptly clicked "Decline" and exited the application. I asked for a credit and was declined because now they charge for megabyte usage no matter what. I have subsequently blocked all such features. Then the have to complicate the fuck out of the billing by saying the bill date is for one period but charging a month ahead. FUCK VERIZON!!!! I FUCKING HATE THEM and will be cancelling as soon as the contract is up. FUCKERS!

My experience with my Verizon wireless crd has been very frustrating. The card is pretty much a piece of shit. I too travel from Texas to Louisiana and it is next to impossible to get a connecting. It usually takes 5-10 attemps, then when I finally do get a connection it's either extremely slow, or I get kicked off after about 30 minutes.

Im just a 15 yr old kid. Well I seem Like nothing to anyone. Well Verizon has thier candy-ass bullshit people that deal with people that have service issues. After an Ice storm my Phone line fell Down I had to Wait 2 weeks for a repair man. Well the line got fixed, and now im having Extreemly Crazy Data Fluctuations from 2 kilobytes per Second (slow as shit), and then my Favorite 10 Megabytes Per second (faster than any shit Ever =] )
When I called another Repair guy, he Blamed my Linux OS. wtf people thats nothing to do with my Internet and phone connection.

You're what we in the industry call "a jumper." You jump from carrier to carrier doing stupid shit and expecting the company you're with at the time to do something about it. Because you don't stay with a company for very long, you can't build up any loyalty, and no one will want to do anything for you. If your rants on here are anything like your rants in a store or over the phone, no one there will want to do anything for you.
All of you assholes on here claiming that you should be able to stream, pirate, share music or video, or play unlimited online gaming: this technology is not for you. You're stretching the bandwith too much, causing others to not be able to use it. You're selfish, and you're too fucking stupid to realize that the Internet isn't your personal pissing ground. If you want to do those things, get a wired connection. That's the end of it. WWAN cannot possibly keep up with what you want to do...yet. Over time the signal strength will get stronger, but it's difficult. You need to study up on WWAN wavelengths and how they effect bandwith. To get the kind of performance you want right now would mean putting a new cell site on every city block, everywhere. That's fine, but it means your broadband service will go up to $500 or so a month, if that's okay with you.

WE have the Technology to recive all the bandwidth in 1 single fiber optic cable. Because of the price most of us cant pay for it. Why dont we start with cable like comcast! they can shuv TV and internet signals in a cheaply installed cable. Fiber Optic cable is much cheaper to make, but to install it and run it; all of the equipment and manhours required to take care of a sigle strand isnt really worth it. SO verizon can suck off. Cable is much better.
