In a better world, the MPD would not have the copyright; they would have hired a private company to produce the video and license it to them. Ideally with contract terms requiring the private company to police unauthorized use of the video.
The website (at least the picture of it shown here) does not accuse dish of being a regulatory profiteer - it just quotes someone else doing so.

I'm reading that paragraph completely differently. To me, it is saying there is a carve out for "slowing down an end user’s connection to the Internet" if chosen by the end user, but *only* if it is not content-specific. So the user choice provision simply doesn't apply.
