The same prosecutor that had him convicted made an official statement two years earlier that it was impossible to convict the pirate bay in Sweden based on previous judgments from the supreme court (in Sweden). Now let's explain the socialist view on the prison system in Sweden. the primary purpose of prison is said to be to reeducate people to normal society. This menas that robbers, assaulters, rapists, drug dealers etc. are very seldomly sent to maximum security in Sweden and isolation is almost unheard of. These facilities are "reserved" for those cosidered to be extremely dangerous, members of violent organized crime or interns that have a high likelyhood of trying to escape. The normal facility for someone like Mr. Sunde would look more like a resort by US standards (all paid for by our tax money). The only reason Mr. Sunde is in maximu security is political. He ridiculed the whole legal system and put such high pressure on the political system that he became a threat.
Yet again; this has nothing to do with whether or not you support TPB. What we're seeing here is politics in its purest form. Og the irony that "The girl with the dragon tattoo" is a Swedish triology because this is more or less the same thing.
To make an omelette you need to break a few eggs. The Pirate Bay and Piratby?n (Pro piracy thinktank) has redefined the whole worlds view on piracy, sharing etc. I don't think anyone missed the fact that TPB promoted piracy just as much as RIAA is still claiming that home taping killed the record industry. You could always go for the lame argument that they were wrong based on the legislation but the same can be said about book printing, the weaving machine and many other technology disruptors through history.
As for DMCA; the last time I checked TPB is claimed to have been run by Swedes in Sweden, the court(s) that convicted them were Swedish. That pretty much clarifies the lack of need to care about DMCA.
Furthermore a number of Swedish law professors argue that as a middle man you can not be convicted for accessory to copyright infringement, especially since noone in Sweden has been convicted for copyright infringement through TPB to begin with. But Oh, I forgot, since when did MPAA & RIAA care about legislation
SInce the lobbyists have to walk at least a mile in Europe (compared to congress walking to the lobbyists in the US) this might be a good thing for us Europeans. I bet most MPAA execs can't tell Belgium from Belarus or Sweden from Switzerland so maybe they'll ignore us after this...
Heavy irony aside those who believe in the "land of the free" should start reading into what Corporativism means and what it's related to (i.e Facism). A country so focused on finding ways to protect the government and the corporations from the people will soon be shaking hands with North Korea and calling communism their new best friend. I don't care who wins the next president election (republican or democrat) but please try to find someone who cares about the voters or soon you wont have to worry about voting anymore.
