    parody okay, but not ?

    So Weird Al could take the song, change all the lyrics to be funny, and it would be okay because its a parody and that is considered freedom of expression. You are free to use a song to express how silly you find it, but not to express how much you like it? Why is expression through parody okay, but expression through homage is infringment?

    Uh oh... If this comment has any impact on the recording industry it will probably be to make Weird Al pay royalties too.

    Ah snap!!! That's a damn good burn!! Seriously though I'm not even joking about blocking Germany. If this ruling is upheld and YouTube has to start being responsible for the content it's users upload, then they NEED to get out of Germany. Heck, if I was a German low-life I'd be very tempted to put my own unsuccessful stuff on YouTube, then sue them. The fact that it's unsuccessful will be the proof that YouTube caused harm :-) There's nothing for Google to hide by pulling out of Germany. If I buy a gun and shoot someone, is it the gun manufacturer's fault? What if our laws said it WAS the fault of the gun manufacturer? What company would be stupid enough to sell guns in this country with such a law? And similarly, why should YouTube stay in Germany?

    quality of music

    Let me get this straight: the music industry is dying which means that there will be little monetary incentive to create music, which means that it will be harder to create high quality work.... hmmmm.... yeah that makes no sense. At present, with a HUGE monetary incentive to be big, people with little-or-no musical talent want desperately to be rock stars. If they are pretty enough (ie. marketable), then someone else can write them a cookie-cutter song, another band can record the musc, and then if the new rock star's voice isn't 100%, we can fix that in the studio and just have them lip sync when on stage. Ask yourself: if there wasn't so much money to be made in music would we still have had to put up with Ashlee Simpson and the like? Probably not. Would we have had bands like Pink Floyd or artists like Bob Dylan without the tons of money thrown at them? I think so.
