I wonder if the staff of CNN and NY Times are worried?
IIRC the senate is responsible for foreign trade deals. The same republican senate that tried to fast track TPP is the senate that Trump has to work with. Do you think they will allow him to ditch the trade deal? After all, its good for American businesses (many of which are owned by non-Americans). Too many companies that will benefit from TPP gave too much money to senators and super pacs to not have the treaty go through.
The best strategy is to ignore the letters. If you do end up in court, the penalty is the real financial loss to the company (what is the profit margin on a music CD) or a fixed amount of not less than $100 and not more than $5000 for all of your previous copyright violations (if the infringement is non-commercial).
if New Zealand and the US sign the TPP treaty, I wonder if he could make a claim under the investor-state dispute mechanism? That would be interesting ....
The previous government in Canada was one that never allowed facts (or reality) to interfere with their ideology.
This is just the beginning (I hope).
The foreign investors in Apple should file a claim under a trade deal. The fact that the apple phone has an unreported bug it in will lower sales and hurt the value of their investment.
Lets assume he did buy the blank video cassette. If he did, can he not sell it under first sales doctrine since the physical item and the copyright are separate?
He should sell it to someone in another country who will stick the game up on the Internet for everyone to watch.
The US used to be believe in capitalism. It seems to have moved to a system best described as corporate socialism.
Under the terms of the TPP, would DOT.COM be able to file a claim under the investor state dispute tribunnal? This definitely seems like a sovereign nation undertaking actions to limit a company's profits
You have two choices when you are being tailgated
1. Constantly slow to 5 miles below the speed limit and then back up.
2. Buy an old boat of car and jammed your brakes on hard when you are beign tailgated. It is not your fault that the car behind you didn't see the "cat" dart out on the road.
If this is constituional, I think I will set up a company whereby people receiving these types of calls can pay a small fee and I will set up a ROBO caller to call every executive, senior manager, adn legal consul for the company stating that my client did not infringe every 60 minutes.
The trade deals protect corporations, not their employees.
If a company does something you don't like, a country just has to declare it a terrorist act and start legal proceedings against the corporations. If the people are unreachable, the expression is exra-judial killings.
The other option a country has is to buy up the stock if the corporation is publicly traded and they have the copnay give them an exemption on the claim, andthen sell the stock. In many cases its probably cheaper than going through the dispute mechanism.
I see some very bad consequences for Australia under their trade treaty obligations.
Lets say I start a service to provide cloud file storage. Someone uploads copyright material to it. The site get banned by SOPA. I file a complaint under a trade treaty for a few hundred million dollars for lost business.
Does Australia have to start paying out millions of dollars for the privilege of having SOPA?
One option governments have for publicly traded companies is to buy up enough stock so that they can control the company, have the company give the government a "pass" on the claim, and then sell the shares (after firing the current management staff of course).
What is the difference between an extrajudicial attack and a terrorist attack?
Does the US and Russia have a "free trade" deal. It sounds like such a court order would require the US government to conpensate the Russian company.
The radio stations lobbying association should get their favourite congressperson to submit a bill requiring record labels and artists to pay radio stations for promoting their music.
To make it more fun, if Quebec bans online gambling sites and they make a claim under one of the so called free trade agreements, the federal government has to pay the compensation to the injured parties. There is really no downside to Quebec for doing this. I am surprised they do not require any Internet site accessible in Quebec to be provided in French.
Trump Land Sky Color
Sometimes I wonder what color the sky is in Trumpland?
