Every single time a company complains in this manner, all search engines should just remove them from their listing entirely.
Blizzard is not making money on the authenticators. They're selling them at cost. This guy still doesn't have a leg to stand on.
The only thing I wish Blizzard did differently about their security is make it so passwords are case sensitive. They've never been case sensitive.
But suing over the authenticator is a dumb move and I hope this person gets laughed out of court.
You can't, it's patented.

Sometimes I pray that companies who patent these absolutely outrageous things are doing it only to sit on them and prevent other unscrupulous companies from abusing them.
Like this patent or the recent Google "Guilt-By-Association" patent.

You have to wonder if it was legitimately a mistake or a tactical effort to get more people on his side.
I had made a purchase of the Star Wars Old Republic mouse from Razer and was forced to use this crappy software when it was still technically deemed a beta. My experience with it was absolutely awful. From the software crashing to freezing up, to not detecting my mouse, to losing my settings when it was unplugged (wireless mode), to telling me my serial number wasn't valid.
I couldn't get any help from support so I returned the mouse. This was my second experience with a Razer mouse. The first one had similar problems with their software (the Synapse 1 software) and it would frequently stop detecting my mouse, revert settings, and take 10-20 seconds to detect after switching modes.
I'm done with Razer as a company. Logitech has never done me wrong.

This is a great idea. Everyone should bring a batch of "*Citation Needed" stickers along with them and post them on these signs.
Banning is a double edge sword.
We already know that OOTB is a certifiable troll and as you said his posts are often flagged almost immediately.
If Techdirt were to swing the banhammer down on that account, then he will almost certainly create a new account to post his drivel under. It make take some time to recognize the new account, weeks that take people longer to flag and hide, meaning more people will read his crud.
People are looking for someone to crucify. Since they can't go after a natural disaster, they're going to find someone.
