There are at least two big fat grounds to sue here. One taking away something that people bought the device for and two discrimination against the handicapped and learning disabled. Do reading machines for the blind also violate the performance rights?

A micro payments system would need to work more like an Easy Pass where you put $30 in an account and have it diminish that account by say a quarter every time you pass through a gate. When the account drops below a set amount- say $5 it dings your credit card for another $30.
Someone would need to setup a similar service to paypal to manage all this and be a fairly universal service to prevent a plethora of competing services to keep down the amount of money individuals would have out for micropayments.

But do they sell those plans as unlimtied cell phone service? It is one thing to sell a package of a known quantity of anything by either weight, volume or time and entirely another to say it is unlimited as long as you don't use too much.
I think what governments can and should mandate is the acceptable methods to measure band width use and how these limits are advertised.

It's FOX they don't get a slow building show. If it isn't a blockbuster right out of the gate they tend to cancel it. SF shows often take a while to build and SF fans tend not to watch FOX shows until they look like they got legs. They have broken out hearts too many times.
