  If the Ozzies continue to go along with the TPP and it's Investor State Dispute provision, would merely suggesting circumventing the geo-blocking allow companies to sue the state for any "perceived" loss of earnings?

  Is HTML 5 an "open" standard? If it is then would it not be possible for another organisation, say the mozilla foundation, to create a completely DRM free version?
  If that could happen I would happily support a DRM free browser.
  
  If they are scared of Hollywood walling things off with their own DRM, they would shit themselves if enough people support fragmenting the "open" standard.

  You are missing the point. The crime in the copyright act is direct copyright infringement. Title 18 makes it also a crime to induce or aid and abet direct copyright infringement. Thus, it is a crime explicitly listed in the US Code.
