    Yep, the Tatoo shop is open to trademark violations... Esp if they have a book of prior works (which they all do), that showcased, such art work... That Giants emblem is a TM violation if its used by the Tatoo artist to advertise his business.

    AC... that's moronic. We live in a representative democracy. Assuming the teacher and school district were doing what they believed was in the best interest of the community they server, it is the COMMUNITIES responsibility to pay. Pay attention to who you vote for and the rules, ideal, and philosophies they intent to implement.

    John... the truck driver that's speeding IS within the scope... as he's "working" while the act happens. Esp if it's found that in order to do his job, he had to drive over the speed limit, or outside of normal sleep parameters...

    If the driver was just driving an empty truck around on his own time, that would be entirely different.

    I hope this guy wins. Normally I'd side with the "he should have been more careful" crowd, but if the bank said it was a go, he has to be able to rely on that. The bank should at least eat his loss, if not the full check amount...

    Maybe if they loose this case, banks in general will do a better job of providing up to date and accurate information to customers.

    I don't agree that the NSA needed to go above and beyond the current legal means, but I also don't want private sector companies being sued for obeying the orders of the president. There must be a better way.

    I agree that what the phone companies did was wrong, but the reasons behind what they did were not their fault.

    Just because two works have similar themes, or lyrics, or melodies, or what not, does not mean that one is COPIED from the other.

    LostSailor, you're wrong.

    I don't think a copy should have an opinion when it comes to upholding the law and arresting drug users... but if the chief of police was quoted as saying he felt people supporting laws relaxing medical weed laws were a "threat"... then yes, I have a problem with that!

    Steven and Jon are better "journalists" than most in the mainstream media today. They present information in such a way that the people get a little informed and want to find out more.

    Not to say that everything they say is pure "fact" or non biased... cuz that's completely untrue... but they lie about trying to be either.

    Wow Cyrix, you must work in the music industry because your bias smells.

    This is like saying putting a radio in a car sells more cars... so the recording industry should get a cut there to.

    Fact is... the songs they're putting in these products sold 6 copies yesterday, and the day after the game comes out they're selling 600.... and the music industry says its all about the songs! WTF!

    Guitar Hero has sold more music than the music has sold Guitar Hero.

    Patent abuse and Copyright abuse...

    are two of the biggest problems the US faces... Not saying our economy isn't bad now, but it doesn't help when leeches suck the blood out of companies that are trying to make due... and force them to either not hire, or lay off workers to pay for moronic law suits like this...

    This on top of the fact that these practices are killing innovation... unless you consider finding ways to screw the system innovative... Why try going into business or selling a new product, or developing the next great idea, when some asshole lawyer will just take it all from you... or end up being your boss...

    Sickening... what can be done to shed more light on this problem? Why the HELLL would Adobe's motion to transfer this case be rejected!? The judge that rejected this request needs to be investigated!

    If a band does not support or believe in the McCain / Palin beliefs and have no plans to vote for them I can see why they would not want their songs used. Using the songs could make the false belief that Heart supports this person... when in fact they do not.


    Uhm, no, I think you're incorrect. Bill Gates can't call up the RNC and decide he doesn't want them using his software after they paid for it.

    Heart produced a product, and once sold, they have very limited rights as to how its used.

    If a person schase someone with a knife in hand -- a person known to have heart problems than that person would be responsible for causing a heart attack. While one is off line and one is online I do not see a different in who caused the damage.


    Chasing someone with a knife is a crime. Harassing someone online was not. That's all that matters.

    If I jumped out of the bushes and scared the old guy with the heart problem, that's NOT a crime unless you can somehow prove I did it with the intent to cause him to have a heart attack.

    So if you want your argument to hold water, compare apples to apples. At the time this happened, there was no law being broken. So don't use a "chasing someone with a knife" analogy because that adds a criminal element that didn't actually exist.

    No, this is why we have judges, to throw out emotionally charged cases like this. If your kid walks up to another kid and says I wish you'd die, and the other kid shoots himself, that's a traumatic experience. Who's fault is it that the 1st kid didn't know that the 2nd kid was already over the edge in a downward spiral.

    Just because the outcome is better or worse does NOT change the law.

    I belive we can all agree that what she did was despicable. Even if there was no crime commited people are sued every day. OJ who was found not guilty had a worngful death suit agenst him for 35.5 million. Just becuse it dose not break the law dose not mean a jury can't still award money it just gets more difficult to prove the case.

    actually, the opposite is true. It's easier to "prove" liability in a civil case that guilt in a criminal case.

    Wow... brilliant! Appears someone was paying attention in the 90s.

    Microsoft released new version of Windows with higher hardware reqs... PC makers sold more high end PCs... which in turn sold more 3rd party software to run on the new PC under the new version of Windows... etc...

    It was a very nice cycle in deed. Even if some people pirated Windows, they couldn't pirate the hardware needed to run windows... Likewise, today, some gamers pirate the latest games, but I guarantee you NVidia (or ATI) got paid!

    the most reasonable thing you've posted. I'm not saying you can guard your kids 100% of the time, but seeing as the kid was diagnosed with depression, you'd think the parents would have been even MORE vigilant in protecting and monitoring her emotional state.

    Now that said... if the girl was that far gone and that close to the edge, then some kid at school could have told her she smelled bad and set her off... So why blame this one woman.

    We don't disagree that this chick is a bad person, but I'm not one to abuse the law in the name of vengeance or vindication. Once we start modifying or making up new criminal law on the fly, we're all screwed. And I for one value the future of our legal system over one family's misfortune.
