Digital Restrictions Management strikes again. Fabulous way to do nothing but piss off your (ex-)customers.
They may not be his only reasons, that is true. However if he lacks the moral courage to state his true objections, refuses to say what everyone knows, then his is complicit in allowing it to continue. Considering the classified briefings that he and the other senators get, there is zero chance that they aren't aware of just how bad it is now. If he (and the other senators) is too much of a moral coward to speak up, then all of the lives this legislation will destroy are on him and the others.
The truth is that ass-hats are everywhere. When you give them superior power, you can take a tiny ass-hat that is bearable and create a significant ass-hat.
Sorry Wyden, it is not about stifling innovation. It is about handing law enforcement a tool they have demonstrated (repeatedly) they will abuse in horrific ways. Fuck the money dude, this would allow cops to destroy anyone and everyone online that they disliked.
People need to remember on thing about lawyers, including David Boies. They are paid to lie. That is there main job. To represent their client to the best of their ability and spout whatever their client tells them too. Even when the client wants them to spout absolute BS. (see David Boies and the Oracle and SCO FUBAR.) It is just not possible to be a high profile attorney like David Boies and not be full of crap. This is why their are supposed to be so many rules and laws governing their actions. To contain their sociopathic actions. They are living examplars of the following quote (Out of context but relevant anyways.)
William F. Buckley, Jr, “I won’t insult your intelligence by suggesting that you really believe what you just said.”
Kamala Harris
Yes, she's a Senator now, but she showed everyone how to do this with her blatantly illegal persecution of Backpage.
In the case I quoted from, a man was convicted of murder. Years later it was learned that the cops and prosecution withheld exculpatory evidence. In addition the real murderer confessed and was tied by forensic evidence to the crime. DNA, fingerprints and whatnot all matched this man. Unfortunately for the judicially murdered man, he had exhausted all of his appeals under state law. That's when the CCA issued it's infamous decision. They KNEW he was innocent, but almost all of the court was made up of far right wing jackasses. Here's a quote that bears on this from Scalia's dissent on a case that reached the US Supreme Court.
"This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is 'actually' innocent," Scalia wrote in a 2009 dissent.
To say that 'justice' in America is FUBAR would qualify as an understatement of Olympic caliber.
"If simply imagining a robbery that won't ever actually happen, of a stash of contraband that does not exist, using weapons you don't have, committed against a victim who does not exist either is enough for a conviction, then I foresee a really sharp drop in the quality of action adventure novels, movies and games."
People are convicted just like this every day in America. And where I live, in Texas, always remember that our Court of Criminal Appeals (highest criminal court in TX) has stated emphatically that "actual innocence is no bar to execution".
It's simple. Their political masters (on both sides) have taught them that appearance matters more than substance.
Proof that sometimes you do get exactly what you paid for. Or as any good Republican would put it, this is just more proof that free market capitalism works. At least as far as buying politicians and bureaucrats is concerned.
Gah, I still can't get this darned markdown stuff to work right.
Let me fix that for you:
Wrong - Digital Rights Management
Right - Digital Restrictions Management
What I wonder is why the hell the courts don't sanction the lawyers who file these patents, or those who defend them like this. According to the Supremes these are bullshit patents and should never be granted. So sanction the idiot lawyers and fire the incompetent patent office examiners who grant these "do something - but on the interwebs!" patents.
It seems that Morlocks make great nerds.
My mother said that words and actions are the two things that define us. One creates the perception; the other, reality. With the DOJ, never the twain shall meet.
Mr. Moss and JTK approve of your choice.
The only real difference is that, by and large, Democrats used to be looking to build. (Now the Dems are just shills for their patrons) Republicans are looking to tear down. (Shills for their patrons and the Dominionists) The problem is, there are few good Democrats left, and the last good Republican left the party years ago. Neo-liberalism killed the Democrats, and the Republicans lobotomized themselves.
Both parties should just be written off at this point. Unfortunately, the reality of our two party system means that their is no chance of a viable third party forming at the national or state level.
Sisyphus looks on in awe as they push this monstrosity up the hill next to him. Meanwhile Gordian just sheaths his knife and mumbles something about eponymous knots and even he can't untangle this one. The Erinyes gaze on, salivating in anticipation; the feast is almost ready for them.
Yes. Free speech is meaningless if it is censored.
They should stay up.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
