With SOPA, the punishments that come with downloading, and the stigma you're trying to put on anyone who does, it seems that downloading is much, much worse then stealing.
I may have a better reason why they're not selling more albums. That reason will take on the form of this question: Who the %$#* is Anthrax?
I know, I know, it's a silly argument, but it's the first thing that popped into my head.
No, what he's talking about is taking those millions of hours and getting rid of each and every one that isn't on a pre-approved list of content creators. That way the risk of copyright infringement is small and those who do can be targeted directly. He completely ignores the fact that this will destroy privacy, anonymity and also block most of new creators from getting a chance to start.
Think of what would happen to Youtube and expand that to the entire Internet. What's he's hoping for is making the Internet one way, a content delivery system only. What he's going to get is the complete destruction of the Internet.
I'm going to make this question as simple as possible. What business models do you speak of that infringe on everyone, all the time?
How does that counter Jay's argument?
That was my first thought. I'm a content creator, where's my money?
"And for what seems like the hundredth time, tell me the new "business model", Mike. Specifically, I'm considering making a movie for $100M, now tell me exactly how I'm assured of recovering "sunk (or fixed) costs", ESPECIALLY with regard to your not worrying about it being pirated.
There isn't a guarantied way to recover the costs. Now before you go "Ah ha, I got you!" know this; there never was. There was always a risk of the movie failing.
There are ways to reduce that risk. Like making a good move, not spending an artificially inflated price for that movie, connecting with fans and building a community, and yes suing the fuck out of those who download.
I just think that the "suing the fuck out of those who may pay" and "remove rights of everyone, not just those who do you wrong" options are just as bad an idea as "give it away and pray" (you know, the way that Mike insists is a bad idea).
This is the same AC that's trying to say Mike "mashed-up" Hillary Clinton's speech to say something she didn't. That's his point, an attempt to discredit TD nothing more.
TechDirt's opinion is obvious to anyone that can read, and I did know that.
So the question becomes; How can you type if you can't read?
I like how you bitch and complain about Mike twisting facts to fit his "pro-piracy" outlook while at the same time you twist facts so you can claim he has a "pro-piracy" outlook.
"Example, a file locker site that requires your ID to open an account, and holds you liable for everything in your account"
But it doesn't matter. There is no trial so whoever feels they've been slighted can just shut the site down anyways. Doesn't matter what's in the TOS.
"Artists would be smart to start their own services, perhaps grouped together, based on the idea of knowing who you are working with."
You have any idea how fast that would be shut down? When one artist can sue and win over 6 notes, no music site will ever survive.
"Can you imagine someone going into a Gamestop with a bunch of burned discs wrapped in a photocopy of the game box, and trying to pass them off as "real" and demanding they take them in trade?"
Two possible outcomes to that. One, the copies are obvious fakes, and GameStop is out money for being dumb enough to buy them. They are not liable. Two, the copies are good fakes and would fool any reasonable person. GameStop is still not liable.
Now, what if you went to GameStop and purchased these reasonable fakes? According to you and this law, you are now guilty of copyright infringement as well as GameStop and subject to all your assets being frozen. You had no idea, but hay, that's the law.
"Know your customer... it's rule 1 for any business."
It's rule 1 for any failing business. Imagine if you had to provide your identity every single time you walked into Walmart on the off chance you may shop lift. Walmart would be dead inside a week. Now extend that to all stores. Bye, bye industrial age, hello agrarian society (though Monsanto will probably screw that up).
"So don't use M$ Windows."
And the billions of dollars in legitimate games and programs US citizens have payed goes up in smoke. Yeah, that's not a reason to switch to piracy.
"Set up an FTP server to transfer directly from your own desktop box."
FTP is not distributed like dropbox is. It's also not encrypted or stored in a bunker like dropbox is. It's also not as easily integrated with my phone and tablet.
And seriously, if this crap passes, Linux is going to be shut down (remember Microsoft says they're infringing) and FTP is next on the chopping block (just as bad as P2P for piracy).
I'll leave the others to rip apart your first point, I'll focus on the last paragraph.
If this is the case, at least the anti-SOPA articles provide links and proof and logic to back them up. You have not, you just spend all your time trying to tare apart his reputation with half truths and outright lies.
This is an open port, you can post proof of your pro-SOPA position. Hell, you would be thanked if you did. Just make it logical and have actual truth.
That entire comment is an epic fail on your part. One, Mike was asked to come to Washington to represent himself, not a lobby. You don't have to make yourself a member of a lobby just to speak in Washington or to be asked to speak.
And the rest of your comment is so wrong, I would say it would qualify as defamation. You're strait up lying with the express intent of doing harm.
You mean his answer to Karl's comment about Mike representing Floor 64, the company he created? The one where he said he only speaks for Floor 64, but he's concerned for everyone?
"how long before one company goes over a competitor's website"
A better question would be; how long will it take to file the paperwork. I'd bet that a lot of places (RIAA, MPAA, Monster cable) already have the paperwork written up and waiting to be rushed off. "How long" is exactly how long it will take the message to get there.
I always look at those and see a smiling guy with a really long nose and a tie.
"but doesn't chance the equation."
Actually it does. They pay for the content, it doesn't need to get payed for twice.
I don't know how many people here would agree, but I'd pay the $140/m for cable (Verizon FiOs technically) if it didn't have commercials. And that's saying something since I only pay $7.99 for Netflix that does the same thing (just a little slower).
"Don't help promote at all."
Nope, providing a simple to use platform adds zero value to the equation. That's why the RIAA told Apple to go screw themselves at the last negotiations where the RIAA thought Apple was getting too much money. The RIAA took their other option and took their music off of iTunes.
Oh wait, that didn't happen. Apple stood firm and the RIAA gave up since they know iTunes does more to sell the music then they can.
Re: Re:
Well, when the wall is trying to kill you, you don't have much of a choice other then to keep beating on it.
For the purposes of this metaphor, "Wall" references SOPA and the assholes who support it and "Kill" references removal of rights (in some ways worse then death).
