FBI Asks Congress To Ignore The Whole 'Probable Cause' Part Of The 4th Amendment

So, in case you haven't been paying attention, the text of the 4th Amendment of the US Constitution reads:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.Pretty straightforward and reasonable, right? Except we've seen an awful lot of erosion of that recently, what with Congress's decision to allow warrantless wiretaps and the Department of Homeland Security insisting that probable cause isn't needed to search your laptops at the border. Well, if it's not needed at the border, why is it needed at all?
At least that seems to be the theory being pushed by the Attorney General, who is asking Congress to approve a plan that would let the FBI begin an investigation and surveillance on someone without probable cause -- actually "without any reasonable basis" at all. That would seem to be in direct violation of the 4th Amendment, but apparently, ignoring the 4th Amendment is all the rage in Washington DC these days.

Small point of correction. The accompanying article neither states nor implies that this was the FBI's idea; it all comes from the Attorney General and the Justice Department. In fact, if they're the highly professional law-enforcement organisation they are generally touted as being, I very much doubt the FBI have any interest in wire-tapping anybody they don't have probable cause on.

Listen, you do not neet Probable Cause to start an investigation, the investigation is where probable cause is developed, "asking Congress to approve a plan that would let the FBI begin an investigation and surveillance on someone without probable cause". At the local level we begin investgations everyday without PC, mear reasonal suspicion that someone is commiting a crime or going to commit a crime will lead us into a surveillance.

When Great Britan ruled the Colonies, officials could search someone even if they had no real reason to suspect that person of crimes.
The Fourth Amendment forbids this. It says that officials need special permission from a judge to search people or their belongings.
This special permission is called a "Search Warrant", To get a search warrant, police must show they have GOOD REASON a law has been broken. And the warrant MUST describe the places and people to be searched and any belongings to be seized.

Hardly. Are "launching an investigation" and "surveillance" are the same thing?. The answer is "no". Surveillance is an activity of an investigation which required judicial oversight, not an investigation unto itself. You can launch an investigation any time, but at the point that investigation leads to surveillance, you need a warrant (judicial oversight).

they're already violating the 4th if they can search your laptop without a warrant. I'm surprised it hasn't appeared in court yet.
Surveillance is not a search of any of your personal/private items. Unless of course they've wiretapped you. Begs the question; if the FBI is sitting outside your house using a laser to listen to conversions is that a wiretap? I would say yes.

Surveillance is not a search. Surveillance is conducted in public places that you do not have a reasonable expectation of privacy. If you are driving down he street I can follow you in any way I want. If you are meeting in a public place I can video and take pictures of you. A search only takes place when one would have a resonalbe expectation of privacy, like in your own home.

Who are they accountable to?
What's troubling is that The Will of the People doesn't have any say to the Congressional "Recall" Process, which like it's cousin, the impeachment process, is initiated internally by Congress.
Thusly, no Member of Congress has ever been recalled in the history of the United States.

The Army
Technically the Army is bound by duty to protect the Constituion and uphold it, even against the government and even the President. Where's the army when you need it?
The government could get around this scenereo by removing the 4th, but that'd cause problems, so they just side skirt the issue by claiming exceptions to the rule.
I'd love to see the National guard go down to the white house and lay the smack down.

Resonable Suspicion has a much lower threashold (in court) then PC. For instance, to stop a car I only need RS, to arrest the driver I need PC.

Read my answer to the Question post. Surveillance is does not need a warrant, only when the surveillance enters an area where someone would have a reasonable expectation of privacy. For instance, a wire tap, requires a warrant in most instances, however there are times when one is not required. When our SWAT team responds to a barricaded subject call I take over the phone every time, without even so much as a call to a judge. We then decide if we let the subject call out, or only talk to us, normally the latter.

The exception? Cops with a WARRANT. They can wait outside my house for me to leave, but if they want in they better prove they have a warrant before hand.

The Attorney General is appointed by the White House. Who controls the White House? It makes sense to put people in positions of the highest power that will favor your ideas and policies. Gonzales did exactly that when he authorized torture, suspended habeus corpus, and pissed on the 4th ammendment. Exactly what Bush and Co. needed to happen for them to sell this war on "terror" on America, and do it without consequence.

So what's your point? Are you saying that the FBI is so stupid that they don't even know that they don't need approval? I think you underestimate the FBI. You should also consider that the FBI may have legal restrictions on its operations that differ from those of local street cops.
From the cited article: "A Justice Department plan would loosen restrictions on the Federal Bureau of Investigation to allow agents to open a national security or criminal investigation against someone without any clear basis for suspicion, Democratic lawmakers briefed on the details said Wednesday."
Remember when the FBI under Hoover would target people for investigation for political reasons in the hopes that those fishing expeditions would produce some dirt that could be used against them? Even if they didn't find anything they could twist into a prosecution they could at least blackmail them with the information in their "investigation" files. Those abuses finally resulted in additional legal restrictions being placed on the FBI. Now there are apparently some in the Justice Department that miss those "good old days" and would like to bring them back by getting rid of those restrictions.

Actually the FBI is bound by the same legal restrictions as a local cop. The only difference is the internal policy and procedures. That said the federal government police agencies put up with some really stupid policies. I work locally but have been involved with 3 letter agency task forces.
The only thing that really scares me about the FBI is that they are charged with the security of the nation (not defense that is the job of the military) and they haven't hired a cop in years. For a long time to get hired by the FBI you had to be either a CPA or lawyer. Cops make great lawyers, but lawyers do not make great cops.
The issue they are really having is in the wire tap area. What really needs to be done is for the courts to define exigent circumstances when it comes to terrorist issues.

The SCOTUS has ruled that it is not unreasonable to require airline passengers and border patrols to take a closer look at your possessions. It is not unreasonable because the alternative is a bunch of guys who want to fly airplanes into our buildings.

That is why you need probable cause. Without that, it’s not reasonable at all. Imagine if the police came into your home without a warrant and said that it’s perfectly reasonable for them to do so because the alternative is you creating bombs in your basement and blowing up downtown L.A.. I see no reason at all why the border would somehow be any different from the rest of the country. And I see no indication in the Constitution to support your privacy-invading non sequiturs.

This is Modern Conservatism . . .
Conservatism means, big government, big spending and a complete loathing of the constitution and the limits on government, especially the executive branch (they want Hobbs Leviathan). At least they can no longer lie about it anymore, after 6 years of conservative rule no one is going to believe those "small government" or "fiscal responsibility" lies anymore. "unreasonable"
This is really a debate over what the word "unreasonable" means in this context.
Obviously, from the comments on this post, most people are ignore or skimming past that word, or implicitly believing that no search is reasonable, and therefore all searched require warrants.
I for one don't have a problem with with the Feds listening on overseas calls that only "enter" the US by a quirk of technology. When I hear people call that "domestic spying" I generally ignore anything they else they say or write and mostly likely to be further nonsense.
Anyways, surveillance (public observation) is not covered by the 4tgh amendment. Starting an investigation is not covered by the 4th amendment.
While the author of the post says the 4th amendment is "Pretty straightforward and reasonable" he sure seems to be confused by it.

You have a point, since the Bush Administrations point of view seems to be that no citizen is ever entitled to any privacy, then there can be no "unreasonable" search, ever. Ironically they also believe that the executive branch can act in complete secrecy and is not answerable to the people or their representatives in the judicial, legislative or even in the press. This is the modern Republican view, totalitarian government rule with an emperor instead of a president. Now that I think about it, Bush may have invaded Iraq, so he could more easily copy Saddam Hussein’s government. After all, the Iraqis never had a terrorist attack under Saddam . . .

Unreasonable Risk and Cost
Instead of creating some fictional anecdotal situation in order to test "unreasonable"
Why not just judge the concept as a whole, is the cost of such a investigative tool worth the risk and cost that would accompany it? One would hope the even the most obtuse fool given those parameters would have to say no.
Gotta love the 9-11/bogeyman/terrorism excuse, our country gets attacked, our nation's security failed on multiple levels, and those responsible for security have the audacity to demand more powers when it was quite effectively proved that they neglected to utilize the powers they already were granted. It's like you own a store and it gets robbed, you find you security guard asleep and instead of firing him/her you agree with their idea to install CCTV's and strip search for all patrons to prevent future security failures

there were at least 10-15 armored cars placed outside 9797 aero drive on sept 11, 2001, the armored cars were part of the signals intelligence program,run by usis. the fbi ordered the armored cars inadvance of sept 11, 2001. which means we knew in advance, the armored cars were ordered at least a week in advance of sept 11, 2001. the san diego field agent was william d. gore, who nolonger works for the fbi. irequested public records document on a sitting county official who broek into my storage unit in the city of san diego. the relation ship between the sitting public official and the sna diego county sheriff department is documented in contract dated back to contract for law enforcement service to 1983 signed by the mayor and the city counselmen. the name of the fbi agent who responded to my friend housw who was employed by us air located on carol canyon road in san diego, the responding agents name was
fbi agent celina narvarro. I am telling you the truth.
usis ALSO HAS CONTRACTS with the national institute of health, these are the facts, they picked up another billion dollars in federal contract paid for by federal taxpayers after 911.

my friend who was ekmployed by us air here in san diego
brought up a copy of the atta itenerary shortyl after plane one impacted world trade center one in NYC, she brought it before plane two impacted the second tower, she came home from work and her husband called the fbi, the fbi came and the agents name was celina navarro, she works out of the san diego filed division of the fbi located at 9797 aero drive, a feew weeks later they got a call from the Unversity of California San Diego, they were told by the caller , the fbi told me to cal you the fbi told me to tell you, you are in alot of trouble , the fbi told me to tell you to bring your computer tower to ucsd , ( a california state school. ) there was no evidece reciept no court order
no search warrant , the fbi buried all the evidence, iworte letter to judge larry burns and attached the atta Itenerary asking him to stand up and do the right thing , but he did not, i told him the computer tower had a manuscript for a book that my friend has just finished writing and that that taking the computer tower was wrong, that was his intellecutal property in fact, I told him
in the letter, that the rigtht way to obtain evidence is to get a court order with the probable cause, the name and address of the person and signed by a judge to grant the order, what was to be picked up in the evidence,then the atta itenerary wouldhave been in the reocrd, but this was not done it was all buried, and i have had federal agent and sheirff at my door. this what happens when you tell the truth. we have had hbo filming a series in the past and wehave also
