Who Needs Cyberlaw?

An interesting interview with law professor David Sorkin talking about all sorts of things concerning internet law. He thinks that many spam laws are terribly written because people writing the legislation have no clue how technology works. As a result they end up trying to ban symptoms, rather than get at the root causes. However, he does think that, in general, the courts do a much better job really understanding technology before making decisions. He thinks the deep linking controversy is ridiculous, and is clearly due to companies who don't understand the web. All in all, it sounds like he thinks that education on how technology works is likely to be a better long term solution than legislation.
