The ACLU spends far too much time being concerned about the civil liberties of illegal aliens, when their mission is to protect the liberties of US citizens under the US constitution. So, they want to stop ICE from using license plate numbers? Do they realize that cars that cross the border both ways, over and over, might be involved in human trafficking? Apparently not.
Court orders are generally written by counsel (in this case, the attorneys for the government) and argued about before they are signed by the judge. As you can see from the document that is linked, it was originally a "proposed" order. No doubt Apple had a proposed order, too, and the judge decided in favor of the government's.
Copy right trumps First Amendment every time. Always has. Get used to it. That said, our Congress is to blame for the 'Mickey Mouse' law that extended the copyright on thousands of works by American authors that would otherwise be in the public domain now. That was a crime.
