Maybe it is time to do a little bit of deeper digging into the superintendent's past. What is she hiding or trying to keep buried that the depiction of her as a "defendant" made her so over-sensitive about? Something hitting a little to close to home, maybe?
If you, as a company, feel the need to put the defamation clause in your terms of service, then you are pretty much admitting right up front that you know that your product is either going to generate significant negative feedback, and/or that you know up right up front that your product or service is an outright scam.
Defense counsel certainly has the right to depose the plaintiff. Proof of identity at the deposition would likely be insisited on. Simply requesting to depose Hansmeier's plaintiff could also have immediately blown it up in Paul's face.
