Not that I think it will ultimately matter, but Verizon has painted themselves in a corner. If they define "passed" the way Kevin Service did, they should be able to provide service to those 42,000 people. If they can't, then, even using their definition of "passed", they have failed to meet their franchise commitment.

Why haven't concerned parties filed a lawsuit regarding Congress giving up it's Constitutional right to oversee treaties? I would thing that would require a Constitutional amendment for that to be legal.
