Record Labels Suing Porn Websites For Using Their Songs

Michael Scott points us to the news that a bunch of big record labels have found their latest target for copyright infringement lawsuits: porn websites. Apparently, some of the websites that make their own videos have been including popular songs — and some (gasp!) even show the actors lip-syncing along. It seems that the porn sites chose songs with… descriptive titles: Justin Timberlake’s SexyBack, Michael Jackson’s Don’t Stop (Til You Get Enough) and Katy Perry’s I Kissed a Girl. Assuming this ever gets to court, you have to imagine it will make for an interesting day in the courtroom when the “evidence” is shown.

Adding video is considered transformative artwork right? Unless the music videos are being ripped off I’m not sure they have a leg to stand on.
I really don’t think people are watching this stuff for the music, they’re watching it for something else.

People typically watch other movies for things other than the music, but that doesn’t mean the movies don’t need to pay to use the music.
Really this is a perfect example of why there should be compulsory licensing of music in movies: porn movies need music, but copyright holders would probably prefer to keep their music out of porn movies entirely rather than negotiate the licensing.

Synchronizing music to visual images is not transformative. This is a very weak argument.
Further, use in pornography may damage the value of a work.
Either way, if film producers use your work, you deserve to be paid for it.

I really think the music industry is hitting rock bottom. Seriously, I wanted to submit this story but I thought it might be rated M for Mature when it came to the content. Usually we try to keep it PG13. Ya know… For the kids.
Anyway, I’d love to see what comes of this but this might make a mess of everything the RIAA stands for.

One more time, the music industry is doing fine. It’s the recording industry that’s failing.
For that matter, the porn industry is doing great, too. They’re taking full advantage of technology to reduce production and distribution costs and lower the barriers to entry. One could argue that the porn industry is the driving force behind a lot of the technology that the music and movie industries use. From home viewing and recording through to internet communities, porn was always an early adopter.
I don’t want to hear those songs anymore. This whole deal with the record and movie companies is getting really boring. To feel so much fear just to listen to some tunes is really getting old. Their reaction to our boycott proves it’s starting to work. You see lot’s of people just stopped buying Sony and the other freedom breakers who sell crap products and then expect you to continue to pay for the rest of your life. Why would you buy something from an enemy? None of these companies are the consumers friend and will sell you a bill of goods rather than simply being honest.
I think it’s just the lawyers on retainers who are trying to justify their fees.
